    With over eight (8) years of distinguished experience in the field of law, including being an Advocate-on-Record (AOR), Supreme Court of India, what initially inspired you to pursue a career in law? What was the driving force behind your decision to join such a prestigious profession?

    Studying law after school was never on my list; I loved Physics and Mathematics, so I chose “Science with Maths” after 10th grade. Simultaneously, I started preparing for IIT-JEE – a common choice for a Science student. One day, on my way to coaching, a traffic police officer stopped me, checked my documents, and made me wait 30 minutes without assigning any reason. I complied, unaware of my rights and the police officer’s powers. This incident sparked my interest in Political Science and Civics, which discussed the concepts of rights, duties, government, democracy, civil liberties, etc. I discussed this new interest with my parents, who were astonishingly supportive of my shift in career aspirations. In fact, it was my father (not a lawyer) who suggested me to pursue a career in law – a suggestion I was keen to explore. The idea that knowledge of the law could empower individuals became a driving force in my decision to pursue law. My father introduced me to a law student, who apprised me of CLAT and National Law Universities. Thereafter, I appeared for CLAT and secured admission to National Law University, Odisha in 2012—an achievement I deeply cherish.

    How has your journey as an advocate evolved, contributing to your expertise and success in the field?

    My journey has been both exciting and challenging. Despite being a first-generation lawyer, I’ve been fortunate enough to have great mentors—from college seniors to the seniors in the profession, especially my bosses—who have played a crucial role in shaping my career.

    Towards the end of law school, I interned with the Supreme Court team at Karanjawala & Co., a top-tier law firm. I was lucky to secure a job there during my internship, marking the start of my career in law. As a fresher, I gained invaluable experience at Karanjawala —assisting in briefing senior advocates, preparing update emails for clients, managing paperwork, and analysing court cause lists. These foundational skills continue to help me till date. I would like to make a special mention of my senior Mr. Utsav Trivedi (now Managing Partner at TAS Law) for his guidance.

    I later joined Luthra & Luthra Law Offices, the team of Mr. Faisal Sherwani, Partner. He was not just a boss, but a true leader—the one who leads by example. Mr. Sherwani has been instrumental in shaping my career and continues to do so. His passion for constitutional law once led to a discussion on the Supreme Court’s judgments on “basic structure doctrine”. This discussion inspired me to prepare for the Advocate-on-Record (AOR) exam. Mr. Sherwani himself is an AOR and I have learnt a great deal from him. 

    At Luthra, I handled diverse matters pertaining to property disputes, IT laws, motor vehicle laws, IP, and criminal law. I significantly honed my drafting skills during my time in Luthra. However, I always aspired to start my independent practice—an idea fully supported by Mr. Sherwani.

    After starting my independent practice, I realized the need to refine my courtroom advocacy. Seeking mentorship, I joined the chambers of a prominent senior advocate, Mrs. Madhavi Divan (former Additional Solicitor General of India), who was kind enough to include me in her team. No discussion on my career trajectory would be complete without mentioning her contributions.

    Madhavi ma’am has a strong work ethic and unwavering consistency in preparation and performance. Despite thoroughly reading briefs, I often felt underprepared in conferences with her, as her questions pushed my intellectual limits. Over time, I began following her line of arguments and anticipating her questions. While assisting her in various matters, including arbitration, insolvency, property disputes, constitutional matters, I learned key advocacy skills—when not to speak in court, how to gauge a judge’s mind, restructuring arguments on the spot, etc. Mrs. Divan has been instrumental in my growth, and I continue to learn from her.

    Having worked with law firms and a senior advocate, what motivated you to establish your own practice? What were the initial hurdles you faced, and what inspired you to take the leap into independent practice, building a firm that reflects your values and legal expertise?

    I think every advocate in dispute resolution aspires to argue before the courts. While working at top-tier law firms, I worked on high-stake matters and assisted in briefing senior advocates but rarely got the chance to argue—rightly so, as I lacked the skills then. However, the urge to start my independent practice never faded. Unfortunately, the demanding law firm schedule left little time to act on it.

    Ironically, the Covid-19 lockdown gave me the opportunity to rethink my career path. Instead of picking up a new hobby, my then flatmate, Mr. Siddharth Jain (now my partner in our law firm), and I focused on taking up independent matters. We started by sending legal notices for corporate clients—companies looking for young lawyers who offered quality work at competitive fees. This instilled confidence in some clients, leading to the launch of our law firm, Jain & Saigal Law Offices, in September 2020.

    Starting out wasn’t easy. The biggest dilemma was leaving a handsome retainer for complete uncertainty—a tough decision every entrepreneur faces. Renting office space, hiring associates, and managing operations brought hidden challenges we hadn’t anticipated. But our determination and positive attitude helped us navigate the journey and build something we truly believed in.

    Starting your career as an associate in law firms and participating in high-profile and landmark insolvency cases must have been a significant learning experience. Could you share some key insights from these cases?

    When I had entered into the profession i.e., in 2017, the Insolvency and Bankruptcy Code, 2016 (IBC) was in its early days. The Reserve Bank of India had identified twelve (12) highly stressed corporate debtors—the “dirty dozen”—for resolution under IBC. Given the stakes, litigation was inevitable, with cases reaching the Supreme Court of India to address legislative gaps and uncertainties in the law. Most of the law firms across the country were engaged in these high-profile matters.

    My interest in insolvency law developed during law school days, even before IBC was enacted. I closely followed mechanisms like Corporate Debt Restructuring and Strategic Debt Restructuring, introduced after statutes such as SICA, SARFAESI, etc. failed to achieve the intended objective. Naturally, I wanted to work on the insolvency matters, and at Karanjawala, I was fortunate to be involved in cases concerning the “dirty dozen”.

    Attending long-hour conferences with clients and senior advocates was invaluable. These conferences made me learn about different perspectives involved in preparing arguments to be presented before the courts. It is not just the provisions of the statutes and their interpretations, or researching the case laws, but also the business’ perspective. In addition to studying the laws applicable, it is equally important for an advocate to understand the intricacies of its client’s business. Laws are meant to regulate business and commerce and not to prohibit them. Thinking beyond legal texts and grasping real-world business implications was my biggest takeaway from these experiences.

    Clearing the AOR exam is a remarkable achievement that speaks volumes about your legal acumen. How did you prepare for this challenging exam, and how has passing the AOR exam enhanced your legal practice, especially in terms of the quality of your representation and legal strategy?

    Preparing for the exam was a nostalgic experience. I studied with my law firm partner and an ex-colleague and a friend I met in Mrs. Divan’s chambers. It felt like college days again—last-minute cramming and somehow making it through. We had organized our schedules efficiently, giving us a full twenty (20) days to prepare. Fortunately, friends who had cleared the exam in the past few years guided us well.

    For me, self-study was the key. I had numerous notes and strategies from friends and other contacts, but they only added to my stress. What truly helped was analyzing past question papers, watching lectures by senior advocates, and studying the material available on the Supreme Court of India’s website. I am immensely grateful to the senior advocates who took time from their busy schedules to help us prepare through their lectures and notes.

    It’s still early to assess how passing the exam has impacted my legal practice, as the results were declared just a couple of months ago. However, the “Supreme Court matters” section in my firm’s “list of matters” is growing noticeably. We remain committed to delivering our best while strictly adhering to the Supreme Court Rules, 2013, and the Apex Court’s directions for the AORs.  

    Representing a high-profile retired bureaucrat in criminal defamation matter, is certainly a critical responsibility. What key legal arguments did you present in this case, and how did you approach defending such a prominent individual against serious allegations, ensuring a successful outcome?

    Unfortunately, this matter is sub-judice before the High Court of Delhi, therefore I cannot comment on this.

    You have been representing homebuyers in multiple courts across Delhi in recovery proceedings initiated by banks against those unable to pay EMIs after being deceived by builders. Could you share the key legal challenges you faced in these cases and the strategies you employed to secure a favourable outcome for your client? Additionally, how do you foresee the evolution of laws surrounding homebuyers’ rights and real estate projects in India moving forward?

    Despite multiple legal remedies available to homebuyers against builders under consumer laws, IBC, and RERA, they lack protection from banks’ recovery proceedings. Many homebuyers, after investing their savings and taking home loans for their dream house, continued paying EMIs, only to realize they had been duped by builders who never began construction or could not complete it in time. When some stopped paying the EMIs, banks initiated legal action(s) against them.

    The clauses of the contract obligates the homebuyers to repay the banks. Therefore, one of the biggest challenges was to determine the appropriate legal forum and remedies to protect the clients from banks’ recovery proceedings. Approaching the Delhi High Court under writ jurisdiction was not fruitful, as the Delhi High Court denied exercising its writ jurisdiction in matters concerning rights of the homebuyers arising purely out of contracts. Thus, beseeching the Supreme Court’s inherent jurisdiction was the only recourse. Initially, the Supreme Court stayed proceedings against homebuyers, but it has now allowed the proceedings before DRT and other tribunals to continue—while prohibiting the issuance of recovery certificates. Additionally, the Apex Court has ordered a special investigation team to probe the nexus between banks/ financial institutions and builders.

    The legal framework for homebuyers’ rights and real estate in India is evolving to enhance consumer protection and transparency. While RERA has strengthened safeguards, enforcement remains a challenge.

    Moving forward, I anticipate further judicial and legislative developments aimed at addressing delays in project completion, streamlining dispute resolution mechanisms, and imposing stricter compliance requirements on builders and banks/ financial institutions. Additionally, the interplay between RERA, insolvency laws and consumer laws, particularly in cases where builders default, might see further clarifications to ensure that the homebuyers’ rights are prioritized.

    There is also a growing demand for digitization in real estate transactions, which could lead to the integration of blockchain technology for property records and increased transparency in financial dealings. The state of Andhra Pradesh has already taken steps in this direction. The role of AI in addressing industry challenges remains to be seen. 

    Your unwavering commitment to the legal profession is truly inspiring. What has been the most rewarding aspect of your legal career so far, and what continues to fuel your passion for law? Additionally, what advice would you offer to the younger generation aspiring to build a successful career in law?

    The most rewarding aspect of my legal career has been the journey of establishing my own law firm. Building my practice from scratch, navigating complex legal challenges, and progressively gaining clients’ trust has been both fulfilling and humbling.

    As a first-generation lawyer, the challenges are constant and sometimes make me question my decision. However, these very challenges push me to improve, adapt, and thrive. The core driving force remains my fundamental duty—to listen to my clients’ concerns, provide them with the best possible solutions available under law, and represent them effectively before the courts.

    I am not sure if I have gained enough experience in the profession to be able to give advices. However, there are a few personal thoughts I can share from my journey so far. As a professional, one needs to always show up and inspire confidence in one’s surroundings—this profession demands commitment, and it is important to rise to the occasion. I also believe that one should broaden one’s perspective beyond law. A fair understanding of business, economics, philosophy, and current affairs can make you a more effective lawyer. Additionally, never trust the shortcuts that would inevitably come your way. Success in any profession is a marathon, not a sprint! Lastly, there is no thumb-rule for success, every individual has its own trajectory. One must trust the process and continue to give one’s best, success and excellence will follow.  

    Balancing a demanding legal career with personal well-being is undoubtedly challenging. How do you manage to strike a harmonious balance between your professional responsibilities and personal life, and what strategies do you employ to ensure that both aspects thrive without compromising either?

    Balancing a demanding legal career with personal well-being is undoubtedly challenging, and honestly, I often find myself struggling to fulfill my personal responsibilities. While I firmly believe that achieving harmony between professional and personal life is essential, I am yet to devise an effective strategy. It is something I am actively working on, especially because my mentors have always emphasized the importance of managing work in a way that ensures every aspect of life is taken care of. I hope that with time and effort, I will be able to strike that balance.

    What initially motivated you to pursue a career in law? Specifically, what led you to explore multiple areas such as service, civil, consumer, and criminal law?

    Initially, becoming a lawyer was not my first choice. I had always aspired to be an Army officer, and even as I was filling out my forms for law school, I was actively preparing for the CDS exam. However, I was selected for a law college before I could pursue that path. Coming from a family with a background in civil servants, I have always been inclined towards securing a position in a government organization. My decision to pursue law was a significant and transformative one, both for me and my family. During my preparation for law school entrance, as I delved into the Indian Constitution, I found myself deeply connected to the evolution of the country post-1947. It sparked a strong sense of purpose in me, and I realized how impactful law can be in shaping the future of our nation.

    Coming from Chandigarh, a tier-2 city, I have come to realize that while the opportunities in corporate law and other specialized fields may be more limited here, it offers a unique and valuable chance to engage deeply with various areas of law, such as service, civil, and consumer law. This environment allows for a more profound understanding of the legal system. In my perspective, anyone looking to start their practice in law should begin by working with district courts and revenue authorities, as they represent the very foundation of our judicial system. Engaging with these entities not only offers a closer connection to the pulse of our legal framework but also provides essential experience in understanding how justice is administered at the grassroots level, which ultimately shapes the broader legal landscape.

    Reflecting on the early stages of your career, could you share some pivotal lessons or experiences that had a significant impact on your legal understanding and contributed to your professional development?

    As I mentioned earlier, I began my practice at the district courts, where my legal journey immersed me in the dynamic world of courtroom proceedings. One of the most crucial aspects that shaped my legal understanding was the art of cross-examination. This stage of the trial process has always fascinated me, as it offers profound insights into human psychology, behavior under pressure, and the intricacies of how individuals navigate high-stakes situations. Conducting cross-examinations on my own provided me with invaluable lessons, not only honing my legal skills but also deepening my understanding of the human condition.

    What concerns me, however, is that the art of cross-examination seems to be gradually fading. I believe this shift is partly due to the growing trend among young advocates to pursue careers in corporate law or other specialized forums, which often overlook the significance of this crucial skill. In my view, cross-examination is not merely a legal tactic but a philosophical exercise in understanding the complexities of truth, human behavior, and the pursuit of justice.

    As a panel advocate for several Government organizations, how do you approach case strategy, particularly in complex matters like land acquisition and service-related disputes?

    In complex matters such as land acquisition and service-related disputes, it is crucial to have a deep understanding not only of the law itself but also of its origins, scope, and underlying objectives. When you truly grasp the scope and purpose of a legal issue, it becomes easier to make informed decisions and strategically approach the matter at hand. Without this foundational understanding — without knowing why a particular law or rule was established and what its purpose is — it becomes much harder to navigate the complexities of the case. In my view, the answers to such intricate legal matters often lie in the origins of the law itself, as understanding its roots provides the clarity needed to address the issue effectively.

    From your experience, what are some of the most challenging constitutional or statutory issues you’ve faced in your legal practice? How do you address such challenges in litigation?

    One of the most challenging constitutional or statutory issues I’ve encountered arises when the remedy does not lie with ordinary courts, and we are compelled to approach the High Court or the Supreme Court directly through writ jurisdiction. In such cases, the High Court often has a broader scope when it comes to constitutional remedies compared to the Supreme Court. The difficulty in these situations lies in the fact that essential elements of the trial process, such as cross-examinations and intent, are often bypassed when we directly approach these higher courts.

    Addressing these challenges requires a nuanced approach to drafting. I personally prefer to draft my writ petitions in an argumentative style. While many lawyers may not adopt this approach, I believe that when the only available remedy is through the High Court, one must put in their utmost effort. The court often relies heavily on the written submissions, and so the quality of the written material becomes paramount. While oral arguments are certainly important, it is the written presentation that shapes the outcome of the case.

    In my view, it’s not enough to merely present questions to the court; it’s essential to provide potential solutions and alternative options for addressing the issue at hand. This, to me, represents one of the biggest challenges we face in legal practice – preparing a case that doesn’t just question the law but offers thoughtful, well-grounded answers to the court, thereby advancing the resolution of the matter.

    How do you interpret Section 85G of the ESIC Act, and what are the key legal challenges you encounter when handling disputes under this provision?

    Section 85G of the Employees’ State Insurance Corporation (ESIC) Act holds significant importance in addressing the enforcement of provisions under the Act, particularly when it comes to ensuring compliance with the obligations outlined for employers and employees in relation to the ESIC. This provision empowers the Corporation to impose penalties for non-compliance, making it a critical tool for ensuring that the objectives of the Act are met—namely, the provision of social security and health benefits to employees in the event of sickness, maternity, disability, and death.

    The key legal challenge I often encounter when handling disputes under Section 85G is interpreting the balance between punitive measures and the broader purpose of the ESIC Act, which is rooted in providing social protection to the workforce. The difficulty lies in assessing whether the penalty provisions, as enforced under this section, are being applied proportionately, keeping in mind the primary objective of promoting welfare and not merely punishing non-compliance. Often, issues arise surrounding the applicability of penalties, the scope of employer responsibilities, and the extent to which employees’ rights are being upheld.

    In interpreting Section 85G, it’s essential to understand the foundational purpose of the ESIC Act: to ensure that employees have access to medical care and financial security, particularly in times of distress. If we focus solely on punitive measures without aligning them with the object of welfare, we risk undermining the core philosophy of the Act, which is to act as a safeguard for the labor force.

    The challenge, therefore, is not only to navigate the technicalities of the law but also to approach it with a broader understanding of its ethical and social purpose. In disputes under Section 85G, I believe that the resolution should always aim to ensure that the spirit of the Act—social welfare and protection for employees—remains intact, even as we address compliance and enforcement issues. In this way, the legal process becomes a means not just of legal correction, but of fostering a more just and supportive system for workers.

    In your capacity as empanelled counsel for Government Organisations, overseeing more than 100 land acquisition cases in Mohali, could you discuss a particularly complex case and the approach you took to ensure a fair resolution of the legal challenges involved?

    As an empanelled counsel for various Government Organizations, I have had the privilege of overseeing a wide range of land acquisition cases, including over 100 cases in Mohali. Land acquisition cases, by nature, are often intricate due to the interplay between legal rights, public interest, and the social impact on the affected individuals.

    One particularly complex case that stands out involved a dispute over the compensation and rehabilitation provisions for landowners whose land was acquired for a public infrastructure project. The case was challenging not only due to the legal technicalities involved but also because of the deep emotional and economic impact on the affected parties. In such cases, the legal process isn’t just about determining compensation—it’s about balancing public interest with the rights and welfare of individuals.

    My approach in this case was twofold: firstly, to ensure a thorough and comprehensive understanding of the legal framework governing land acquisition, including the constitutional principles of fairness and just compensation. This required an in-depth review of the relevant statutes and precedents, as well as the specific nuances of the land acquisition process in Mohali.

    Secondly, I sought to address the human element of the case by engaging with the affected parties in a constructive manner. I believe that the resolution of such disputes must go beyond the rigid application of law; it must take into account the broader social impact. To this end, I emphasized the importance of fair compensation, not just in terms of monetary value but also in ensuring proper rehabilitation and resettlement for those affected.

    Throughout the legal proceedings, my primary focus was on ensuring that the rights of the landowners were protected while also upholding the public interest. By presenting well-reasoned arguments, addressing both legal and human considerations, and seeking a fair resolution for all stakeholders involved, I was able to guide the case towards a resolution that was just, equitable, and aligned with the broader goals of the land acquisition process.

    Philosophically, I view land acquisition not merely as a legal transaction but as a fundamental issue of justice—how we balance the need for public infrastructure and development with the rights of individuals who are directly affected. In this sense, my approach has always been to ensure that the law serves its true purpose: not just to resolve disputes, but to advance fairness and social welfare in a way that respects the dignity and rights of every individual.

    What are the primary challenges the Legal Services Authority (LSA) faces in managing the high volume of cases it handles?

    The Legal Services Authority (LSA) faces significant challenges in managing the high volume of cases, primarily due to limited resources and a backlog that can delay timely resolution. Another challenge is ensuring equitable access to legal aid, as many individuals remain unaware of their eligibility. Additionally, the allocation of cases to qualified advocates and maintaining the quality of representation amid the large case load can be difficult.

    Philosophically, the core challenge lies in balancing the ideals of justice and equity with the practical constraints of the system. The LSA must continue evolving, utilizing technology and increasing awareness to ensure that the principle of equal access to justice is upheld, even when faced with resource limitations.

    Given your demanding professional commitments, how do you maintain a healthy work-life balance and ensure your personal well-being while managing your extensive responsibilities?

    Maintaining a healthy work-life balance, especially with the demanding nature of my professional commitments, is undoubtedly a challenge. However, I believe that a balanced life is not just essential for personal well-being but also for professional effectiveness. I approach this balance by prioritizing time management and setting clear boundaries between work and personal life.

    I make it a point to allocate specific time for relaxation and activities that nourish both my body and mind, such as exercise, reading, and spending quality time with loved ones. These moments of rest allow me to recharge and maintain the focus and energy needed for my legal work.

    Philosophically, I believe that a well-balanced life is essential to maintaining clarity in decision-making and ensuring that I approach each case with the full depth of attention and care it requires. If we are to serve others through our work, we must first take care of ourselves, as only a well-nourished mind and body can truly contribute to the well-being of others. By maintaining this balance, I am able to bring a more focused, compassionate, and strategic approach to my professional responsibilities.

    How do you define law, and what do you believe is its fundamental role in society? Additionally, which subject you liked the most while studying law? And why?

    Before attempting to answer what is perhaps one of the most profound questions pondered by leading legal theorists for centuries, I’d like to approach it in simpler terms. Law, in my view, can be understood in two dimensions: descriptive and normative. Descriptive law refers to how the law is—it encompasses the characteristics, structures, and functions of legal systems as they exist in practice. It’s the study of law in its current form, outlining how it governs society, resolves disputes, and maintains order.

    Normative law, on the other hand, concerns how the law should be. It’s rooted in ethical principles, moral reasoning, and the vision of how law ought to evolve to meet the needs of justice and fairness. In essence, it addresses the ideals, the aspirations that guide legal reform and transformation.

    Both aspects—descriptive and normative—exist simultaneously within the concept of law. This duality is what many of our great legal theorists have grappled with over time, saying: “This is what law is like, and this is how we ought to regard it.” It is in understanding this tension between what the law is and what it should be that we begin to appreciate the deeper philosophical nature of law.

    Law is not merely a static set of rules, but a living framework that both describes societal structures and, through normative claims, aspires to shape them in accordance with principles of justice, equity, and the common good. In my view, it is this interplay between the descriptive reality and the normative ideal that gives law its power and its purpose in human society.

    With regards to the second part of the question, during my law studies, I found Jurisprudence to be the most fascinating subject, as it goes beyond rules and procedures to explore the philosophy of law. It raises essential questions like “What is justice?” and “How should law reflect societal values?” What I find compelling about Jurisprudence is its ability to connect legal theory with real-world practice, making law a dynamic framework that shapes and reflects our social, moral, and cultural beliefs. It encourages critical reflection on the deeper purpose of law, emphasizing its role in ensuring fairness, equity, and justice. For me, Jurisprudence reaffirms that law is not just a set of rules but a tool for building a just society.

    What in your opinion are effective ways that can reduce the pendency of courts?

    As a lawyer who has had the privilege of engaging with all levels of the judicial system, from district courts to the Supreme Court, I have had firsthand experience of how the system operates and where the challenges lie. One of the most pressing issues I have observed in reducing the pendency of cases is the need for stronger support at the grassroots level, particularly at the district court level. The vast majority of cases affecting ordinary citizens begin at this stage, and unfortunately, we often see a shortage of well-trained, efficient lawyers at this level.

    The issue of infrastructure is another significant challenge. While higher courts may be more equipped, the district courts often lack the resources to handle the volume of cases effectively. This disparity in infrastructure and legal expertise at the grassroots level contributes to delays and inefficiencies in the system.

    We often celebrate the ‘brain drain’ when Indians excel globally in fields such as technology and science, but unfortunately, we are witnessing a similar trend in the legal profession. Many skilled lawyers are leaving the traditional legal practice in Favor of corporate careers, leading to a shortage of competent legal professionals at the district court level. If we are to reduce the pendency of cases, it is essential that we invest in building a strong legal foundation at this level by attracting and retaining talented lawyers to serve in district courts.

    Additionally, the introduction of more efficient case management systems, digitization, and the expansion of legal aid services can help alleviate the backlog. A holistic approach that includes better infrastructure, legal support, and technological solutions can create a more efficient and accessible judicial system.

    I believe that the judicial system must serve the people at every level, not just in the higher courts. By focusing on improving the quality of legal representation and the infrastructure at the district court level, we can ensure that justice is not delayed or denied, and that the system becomes more responsive to the needs of the common people.

    For aspiring lawyers or young professionals aiming to build a career in multiple areas of law, what advice would you offer? Are there any particular resources or strategies you recommend to help them stay current with evolving legal trends? Could you also share the most recent book you have read?

    Being in the early stages of my career, I believe it’s crucial for aspiring lawyers or young professionals to establish a strong foundation by reaching the court regularly and engaging with real-world cases. The prime duty of every lawyer is to be present in the courtroom, attend hearings, and ensure they are always up-to-date with the most recent orders passed by the honourable court. Once you prioritize your work in this way—by staying punctual and attentive to the finer details of each case—you will find the work becomes more manageable, and your chances of success naturally increase. This consistent engagement with the court not only hones your practical skills but also fosters a deeper understanding of legal processes and the nuances of each case.

    In addition to courtroom experience, it’s vital to stay current with evolving legal trends. I recommend that aspiring lawyers read widely—both legal journals and case law—to stay informed about new developments in law. Participating in legal seminars, webinars, and discussions with experienced professionals also offers valuable insights into emerging trends and shifts in legal practice. More importantly, I believe the pursuit of continuous learning should be a philosophy that guides one’s career. The law is dynamic, and as lawyers, we must remain adaptable and open to new perspectives and ideas.

    In terms of resources, I would suggest exploring both traditional texts and newer platforms, such as online legal databases, that provide real-time case law updates. Platforms like Manupatra, SCC Online, and legal blogs can be invaluable in staying on top of legislative changes and judicial interpretations. Above all, my advice would be to approach your career with a balance of practical engagement and intellectual curiosity—viewing the law not only as a profession but as an ongoing journey of learning and growth.

    The most recent book I’ve read is Leviathan by Thomas Hobbes. In this influential work, Hobbes explores the nature of human existence, governance, and law. He argues that without a central authority, life would be chaotic and brutal. To avoid this, individuals must give up certain freedoms to a sovereign authority in exchange for security and order, forming the foundation of the “social contract.” Hobbes’ ideas not only shape political theory but also raise fundamental questions about authority, power, and justice. His reflections on law highlight its role in maintaining social structure and preventing anarchy, offering timeless insights into the balance between individual freedom and societal order.

    With nearly 18 years of experience in law, what initially drew you to the legal profession? Was there a particular event or experience that influenced your decision to pursue this path?

    My father was an Engineer and he was always attracted towards law. While he was posted At Lucknow working as Junior Engineer in Public Works department and completed his law from Lucknow University while in service. He always said that a lawyer is a person who is always wanted by society. After completing my 12th from Boys High School  at Allahabad I got admission in I. L.S. Law College Pune, which was one of the best Law Colleges in India in 2000. 

    During your time working with Senior Advocate Mr. Anurag Khanna, what were some of the key lessons or insights you gained that significantly impacted your approach to law?

    My time working with Senior Advocate Mr. Anurag Khanna was very fruitful and a learning experience. The most significant lesson I learned was sincerity, perseverance and honesty. My senior while going through any  file of a case would always look for the best legal point available to get the case admitted on first hearing and obtained a favourable order in favour of the client. His approach was to look for the one bullet point in the case that will force the Judge to pass an order in favour of the client. 

    After gaining valuable experience under the mentorship of a senior advocate, what inspired you to branch out and start your independent practice? What were some of the initial challenges you encountered, and how did you overcome them?

    After working for around 8 years under the mentorship of the Senior Advocate I started feeling that 8 years is a sufficient time to get the insights as a junior and I should start my own independent practice. Once I started my own independent practice initially the work load was less as I had few briefs but slowly with sincerity and perseverance I was able to get more briefs. This profession needs a lot of patience and hard work. That it is really tough for first generation lawyers, who have no background in law. 

    You’ve worked on petitions under Section 391-394 of the Companies Act. Could you share your perspective on the complexities involved in such petitions and some of the challenges you’ve faced? Additionally, in your experience with liquidation matters, what do you consider to be the most common obstacles companies face in these situations?

    The provision relating to amalgamation and mergers or restructuring debt was earlier covered under section 391-394 of the Companies Act, which is now being dealt with by National Company Law Tribunal. The most interesting part was the meetings which were to be conducted of shareholders of the companies, wherein 75% voting was required to be in favour of the scheme then only the scheme of merger or amalgamation could get through. The meetings were conducted in some other cities for which we have to travel. I have participated in such meetings in Jaipur, Mathura, Agra as Chairman and alternate Chairman. The Liquidation matters are the most complex and lengthy litigation which goes on for 10-20 years without being concluded. Sometimes the companies which are in liquidation can also be revived if they have a feasible revival plan. 

    You’ve been involved in land acquisition cases for authorities like NOIDA and handled cases under the Land Acquisition Act. What legal and ethical considerations do you think are crucial in these matters? Could you share an example of a particularly challenging case you’ve worked on?

    The land acquisition matters mostly relate to the land of the farmers which are acquired by Noida and other Authorities for different purposes including Plant Industrial Development. The land acquisition cases are very fulfilling for a lawyer as the Advocate has to fight for the farmers’ rights. Recently I am working on a case wherein illegal classification was made by the Noida Authority between farmers themselves for two categories Pustaini and Gair Pustaini meaning ancestral and non ancestral land owners. The classification has been held to be illegal in the case of Ramesh Chandra Sharma by the Hon’ble Supreme Court but in spite of the judgment of the Hon’ble Supreme Court is not giving the benefit to the farmers for which we have filed various petitions on behalf of farmers and hearing is going on since past one month. 

    Your experience includes dealing with labour disputes under the Provident Fund Act and Industrial Disputes Act. What are the most common labour-related issues companies face today, and how do they typically navigate these challenges?

    The Labor Laws in India are welfare statutes tilted in favour of the laborers. That the companies are being burdened with false cases which are being initiated by the laborers against the company. The most common tactics is to work for more than 240 days in a company and thereafter leave the company to get another job at a higher salary in another company and thereafter raise labour disputes and get benefits under various Labour Laws and also demand back wages. 

    In your role assisting with high-profile criminal cases, such as the Aarushi Talwar case, what are some of the major challenges you’ve encountered in criminal law, particularly with regard to public perception and media coverage?

    In the Indian Democratic system, the media nowadays plays a very vital role as far as high-profile cases are concerned. The best part is that judges are not affected by the media coverage. While assisting Senior Advocate Mr. Anurag Khanna in the Aarushi Talwar case for the Central Bureau of Investigation. I had a chance to work for the prosecution. We were opposing the cases filed by Aarushi Talwar’s parents. The Division Bench of Allahabad High Court gave a verdict in favour of the parents of Aarushi Talwar. It was a great learning experience.

    As technology continues to play a larger role in the legal field, how do you believe it is impacting corporate litigation and legal practice overall? Looking ahead, what trends do you think will become more prominent in the next five to ten years, especially in corporate law and litigation? How do you keep up with emerging legal trends?

    Technology has been playing a very important role in law as one click we can search through lakhs of judgment. Chat GPT and AI will probably become more prominent in the next 5-10 years in corporate law and litigation. Due to technology the judges and lawyers are more updated and are aware of the judgment which is being pronounced every day by different courts throughout India. The technology cannot overtake the legal profession completely and the lawyers, clerks and judges will always be there to take forward the legal system. 

    Finally, what advice would you offer to young lawyers who aspire to make a lasting impact in their careers, particularly those with an interest in corporate and litigation law?

    The young lawyers are the light for tomorrow. I see young lawyers to be very well versed in law and technology but they are lacking patience which is the most important aspect of litigation. I would advise the young lawyer not to take shortcuts and wait till your time arrives till then he should keep working hard.

    Your extensive experience and diverse areas of practice are highly admirable. What motivated you to choose a career in law, and what factors influenced your decision to pursue this profession?

    Choosing a career in law was a decision driven by both inspiration and a deep sense of purpose. Over the years, my journey in this profession has only deepened my appreciation for its intellectual rigor and dynamic nature. The legal field is an ever-evolving landscape, and even after a decade of practice, I find myself constantly learning and adapting.     After completing your Law degree, what led you to choose the University of Glasgow for your LL.M. in Intellectual Property and Digital Economy? What aspects of this specialization interested you, and how did the university’s teaching approach stand out to you?

    After completing my 5 year course from Institute of Law, Nirma University, I started practising before the Rajasthan High Court and gained some valuable experience. It was during this time that I realised that it was the right time for me to devote some additional time towards academics. Since Intellectual Property was my major subject in law school and I had developed a peculiar interest in it I decided to look for universities offering post graduate degree course in this subject. A few major considerations for me while deciding the university were firstly of course the curriculum and the professors but as I started with my list of universities, apart from the above the next few considerations which came were the cost of living and the expenses to be incurred apart from the tuition fee. While I got offers from University of Manchester, Edinburgh and Warwick, I finally selected the University of Glasgow for it having the most advanced course module which dealt with Intellectual Property in Digital Economy. My course included subjects of brand protection, moral rights in copyright which was also the subject of my thesis at the University. 

    As far as the teaching pedagogy of the University of Glasgow I should admit that I was literally taken aback in the initial weeks as the classrooms were more of discussions where students coming from different backgrounds used to share their insights and their understanding of the subjects. The professors used to share articles and course materials beforehand and the classes usually happened in a manner where the floor was left open for discussion on the understanding of the subject and for sharing the analysis of the material. A significant part of the discussions in the class was having students from different backgrounds where they would shed light on the laws as in their respective countries. I had the privilege of discussing the Indian IP laws and I should say that some of our judgments particularly on fair use of copyrighted material specially course books and patents applications for generic medicine were quite a hit amongst the class. I believe the type of teaching approach followed at the University was absolutely outstanding as in most of the discussions there were no wrong answers, just observations, analysis and critiques by students which helps in gaining a new perspective, something which cannot be done if the classes are merely discussing the views of the authors. 

    As you were starting your career, what were some key experiences that served as valuable learning moments and have stayed with you throughout your journey?

    When I had just begun my practise, a very kind senior of mine told me that as a lawyer, its your duty towards the client as well as the Court that you should always be thoroughly prepared, you should know the facts of the case, the applicable substantive and procedural laws and the relevant judgments on the subject. This commitment to diligence has been my guiding principle. One of the most valuable lessons I’ve gained is that no two cases are alike, and each case presents an opportunity to learn and grow. Whether it’s through direct mentorship, observing senior counsel in court, or engaging in discussions with colleagues, every experience has contributed to honing my legal acumen.

    These experiences, coupled with the guidance from mentors, have shaped the lawyer I am today, and I continue to carry them with me in every matter I handle.

    What inspired you to establish your own practice, Arcas Law? What were some of the early challenges you faced, and how did you overcome them?

    This is something I believe every first generation lawyer dreams of the moment they enter the profession. I have been blessed to have worked with some of the most brilliant minds in this profession who were kind enough to not just help me grow but also taught me the nuances of practice of law and more than anything the art of advocacy. I truly and most humbly believe that having a good senior by your side is the single most important thing in this profession. There are numerous occasions where you just want someone to guide you to the right direction and that is what inspired me. I have been closely associated with people who I have seen working very hard in established law offices and firms and I have seen them set up their own offices and that just lit a spark in me that I too wanted to follow their path. Now that I think of it, I just wanted to be like them because I admired them so much. 

    Initially, yes there are few things which need attention and once you make the switch from being in an office to having your own office it is only then that you figure them out. I was lucky that my colleagues and staff were very accommodative and adjusted well to the change. From day one in our office we had a few ground rules which I carried forward from my previous office where the work is aptly delegated and divided amongst the staff, we have regular meetings to discuss the ongoing work and to also discuss about the functioning in the office, and all of which helps in streamlining and getting work done at the right pace. 

    With your extensive experience as an AOR before the Supreme Court of India and representing high-profile clients such as Mahindra & Mahindra and ICICI Bank, is there one case that particularly stands out as memorable? If so, could you share your experience dealing with that case and how you prepared for it, with our readers?

    I have always believed that no matter is ever big or small and that every case or brief deserves the same amount of respect and dedication. As a matter of practise at our office we always strive to strike a balance between the type of cases that we take up, so on one hand while we are dealing with matters relating to commercial interest of companies and other matters involving substantial transactions, on the other hand we also have matters which we take up on pro -bono basis and  more often than not that it is the latter type which always stands out for me in terms of being memorable. 

    I can tell you about a few recent ones that our office dealt with and I am very happy to share that in one of them the Hon’ble Supreme Court settled the law with respect to the offense of abetment vis-à-vis the offense of bigamy. In this matter we were appearing for the wife whose husband allegedly got married for the second time. However, the Hon’ble High Court allowing the petition filed by the relatives of the second wife held that bigamy is not an offense of wider amplitude and thus there can be no question of its abetment and allowed the Petition thereby setting aside the summoning order. Interestingly, the Petitioner in this case first approached the Legal Services Committee which rejected her case saying that there are no grounds to interfere with the judgment of the High Court as it is on sound principles of law. 

    When the Petitioner approached us we ran through the papers and found that the observations of the High Court were completely uncalled for. We decided to take up the case pro bono and during its preparation our entire office was busy collating judgments and going through commentaries on abetment and bigamy and once we were done we had judgments ranging from 1902 to 2024 covering the subject. We argued our case before the Hon’ble Apex Court and the Bench of the Hon’ble Chief Justice was pleased to note that the observations of the High Court on bigamy were in teeth of the judgments of this Court and further also set the principle that the offense of abetment to bigamy is applicable and can be imposed when conditions are met. 

    Similarly we had another case where we were appearing pro bono for a deaf and mute person and our challenge was that the disability of the person cannot be used as a ground to deny him his basic rights. In order to research for the same we went through a lot of literature on sign language and even the different types of symbols & signs and also learnt how the same sign used can have different meanings as this sign language varies in regional languages. I would say it is always the preparation of these cases that is the most memorable part for me.

    Given your specialization in Intellectual Property law and the growth of e-commerce and technology-driven businesses in India, how do you envision the future of intellectual property protection in the digital economy?

    Every industry player, be it in any kind of industry, wants to make sure that their product or service be associated with their name or mark or their brand and that the customer should not come looking for the service or the product but should come for the name. This is where the role of intellectual property comes in. It is a very vast subject and the implications it can have on one’s business are huge.

    The digital economy is characterised by its global outreach which involves innovations at a rapid pace and places huge reliance on intangible assets. Thus, having a robust and strong IP presence is at the heart of every business strategy. 

    In this dynamic environment, the most important thing that people or consumers look for is authenticity and trust. Intellectual property is literally the backbone of these attributes as it creates a foundation that allows business to distinguish themselves in this crowded digital marketplace. 

    A strong mark creates that bridge of trust between a business and its consumers which is more relevant than ever in the e-commerce era and technology driven sectors as the physical interaction with the product is almost zero and the decision hinges particularly on the reputation and goodwill associated with the brand. 

    But when we talk of the future of IP in this digital economy it hinges on and is intrinsically tied to the ability of stakeholders to adapt to new challenges. On one side we have the global reach of the digital marketplace but we also need to keep an eye on the amplified risks associated with IP infringement in the digital space and as we witness the evolution of AI, there is no dearth of methods that can be used to exploit the gaps in IP protection. I would say that any business that takes Intellectual property as a strategic asset will not only be in a position to safeguard its innovations but will also be able to cement its place in the digital economy. 

    In your experience with real estate law, what do you believe is the biggest challenge facing developers and homeowners in India today?

    I think the aspiration of owning a home contributed a lot towards the development of real estate laws. In fact there was a time when everyday the newspapers used to be filled with advertisements of new housing and commercial projects coming up which would boast about their spacious apartments, extra facilities like gyms, spas, and landscaped gardens. Homebuyers and investors, lured by these promises, poured significant resources into these projects, often viewing them as secure and high-yielding investments.

    However, the real estate market is not immune to macroeconomic factors. Over time, rising inflation, increasing construction costs, and growing interest rates created a ripple effect that significantly impacted the financial ecosystem of this sector. One of the most critical challenges that emerged was the cyclical nature of defaults. A delay or default in payments by homebuyers often strained the liquidity of developers, causing them to default on their financial obligations, including project completion. Conversely, when developers failed to deliver on time, homebuyers faced financial distress, particularly those servicing home loans. 

    The result is a pervasive sense of mistrust and financial instability, which has triggered a flood of legal disputes between developers and homeowners and the same has thus manifested across various legal forums like consumer commissions, RERA and even NCLT. 

    A key challenge that becomes a major issue in the real estate sector is the financial interdependence of buyers and developers. Sometimes delays in payment can cause a domino effect and the entire project suffers. Additionally this sector is also exposed to certain broader economic and policy issues such as land acquisition, inflation, market fluctuation which add to the complexity. 

    Another key challenge for developers is navigating the different regulatory frameworks. While legislations such as the Real Estate (Regulation and Development) Act, 2016 (RERA) aim to ensure transparency and accountability, compliance can be burdensome, particularly for smaller developers. On the other hand, homeowners often face the challenge of enforcing their rights in the face of delays, substandard construction, or outright abandonment of projects. For many, the legal process can be daunting, time-consuming, and financially draining.

    What advice would you offer to young lawyers who aspire to have a successful career like you as an AOR? How can they best prepare for success in these fields, and what challenges should they anticipate?

    The transition from law school to practice can be very overwhelming. Early in the career, lawyers may often feel that the financial returns are not to be commensurate with the effort that is being put in. To all the young lawyers and students reading this I would say patience and perseverance are very crucial in this phase. Litigation demands unwavering commitment, discipline and adaptability. A litigation office often operates like a fire brigade where unexpected challenges arise and immediate action is required. Litigation often involves juggling multiple cases with overlapping deadlines. Time management and prioritization are critical. 

    As an AOR, drafting pleadings and petitions is a significant part of your role. Meticulous research and clear, concise drafting can make or break a case. Cultivate the habit of reading judgments critically and understanding the reasoning behind them. At the same time, young lawyers need to work hard to familiarise themselves with the emerging technologies and be savvy with legal research platforms, case management software, e-filing systems, and virtual court proceedings. 

    To build a successful career as an AOR or as a lawyer preparation and persistence are key. While preparation will always remain first, the art of presentation is as important. Pay attention to how senior lawyers argue their cases in court. Learn the art of persuasion, and work on your confidence and communication skills. 

    Given the demands of your profession, how do you manage to unwind and maintain a healthy work-life balance?

    The profession has its perks. Many would agree that as lawyers, we are fortunate to have the benefit of scheduled vacations—once during the summer, once in the winter, and a handful of breaks throughout the year. While our work philosophy is firmly grounded in the “work comes first” principle, we are also mindful of the challenges posed by such a demanding profession. Balancing personal well-being alongside professional responsibilities is essential.

    For me personally, travel plays a significant role in unwinding and recharging. I’ve discovered that I am more of a “lazy traveller,” someone who eagerly looks forward to new destinations but ends up spending most of the vacation relaxing, sleeping, and taking it slow. This approach allows me to truly disconnect from the pressures of work and focus on re-energizing myself. Whether it’s exploring a new place or simply enjoying a change of scenery, taking time off helps me return to my practice with a renewed sense of purpose and clarity.

    Looking at your impressive career in corporate law, what initially inspired you to pursue a legal career, and what piqued your interest in areas like Cross-Border Transactions, International Trade, and FDI?

    From my childhood days, I always looked forward to pursuing a career in law. Further, my inclination for corporate law started from the days when I was in my seventh semester of the five-year law course. Subsequently, in the initial years of my practice, I had the privilege of working with some of the biggest corporates globally, handling their legal matters. These experiences solidified my passion for corporate law, particularly in Cross-border Transactions, International Trade and Foreign Direct investment they offer dynamic challenges and opportunities to contribute to the global business landscape. So far, I have successfully executed five multi-million dollars foreign direct investments (FDI) in India, providing strategic support to foreign investors in navigating the complexities of Indian market. Further, with respect to International Trade numerous disputes have been handled by me and my law firm/office and amicably resolved, consistently achieving favourable outcomes for a niche and discerning clientele. These experiences have underscored the immense potential for growth, both in terms of professional learning and financial opportunities, in practicing corporate law within specialized areas such as Cross-Border Transactions, International Trade, and FDI in India. This niche focus has allowed me to develop a deep understanding of the legal and commercial nuances in these domains, further enhancing my ability to deliver tailored and effective solutions.

    Having gained significant experience with various law firms early in your career, what were the most valuable lessons you learned that deepened your understanding of this profession?

    Working with various law firms, the most valuable lessons I learnt are to be thorough with research and respect the timelines. These lessons shaped my approach to providing reliable and timely solutions in my legal practice. Apart from these, one has to follow a proper schedule and endeavour to develop a robust system not only within himself/herself but also within the organisation. One has to be always updated with respect to the latest developments in the legal arena and especially with respect to the practice areas where the Advocate is offering legal services. Court visits are must throughout the career as it gives in depth insights with respect to the constant evolution of the legal system. Certifications and courses should be availed and completed with respect to the particular practice area where the Lawyer choses to specialise or opt for in his/her career path.

I approach the arbitration process with a specific strategy wherein our clients’ claims or counterclaims are strategically presented to be well-placed in the case. Further, continuous efforts for amicable resolution of disputes and entering into firm negotiations are equally important. The Arbitration & Conciliation Act of 1996 has seen requisite amendments and the Union Parliament is making endeavours to make the arbitration process more friendly and swift. Further, International Arbitration Centres are already set up and working in Delhi and Mumbai and the entire arbitration process is being streamlined in such a way to achieve the objective of the Act. The future of arbitration is bright and young Lawyers should endeavour to explore career opportunities. There are also specific certification courses offered by Colleges, Universities and several online platforms which can be definitely pursued by young Lawyers to attain deep knowledge and skills.

    After working with several prominent firms and legal entities, what motivated you to establish your own practice, and what were the initial hurdles you faced when setting up My Lawyers Advice?

    Motivation to Establish My Own Practice: The idea of starting my own practice wasn’t something that came up overnight. During my college days, my batchmate, Mr. Rituraj Kumar, and I had already decided that one day we’d set up our own firm and work together. We shared a lot of milestones graduating together, enrolling with the Bar Council of Delhi, taking the AIBE exam, and clearing it in one go.

    Afterward, we intentionally took separate paths, working with different firms and legal entities to gain as much experience as possible. These years were about sharpening our skills and understanding the profession better. In 2014, we finally took the leap and started our independent practice with a small office in Connaught Place, Delhi. While many have joined and moved on from our team, Rituraj and I have remained a constant, working together as partners since day one.

    Initial Hurdles in Setting Up My Lawyers Advice: One of the biggest challenges we faced was figuring out how to create meaningful, value-driven content for the public. My Lawyers Advice (https://mylawyersadvice.com/blog/) was launched as an online platform to provide free legal knowledge through blogs, but producing consistent, high-quality content was a daunting task at first.

    This hurdle was overcome thanks to our partnership with LawSikho, which provided us with talented law students who worked as researchers and sometimes even co-authors. With their support, we’ve managed to publish over 750 blogs in the last four years. Today, we still work with fantastic interns from LawSikho and collaborate with their Legal Freelance Team to create top-notch, research-based solutions for our readers.

    Looking back, those initial challenges were tough, but they pushed us to grow and innovate, laying a strong foundation for what My Lawyers Advice has become today.  

    Given your experience in structuring Foreign Direct Investment (FDI) and advising international clients on entering the Indian market, how do you navigate the complexities of aligning foreign businesses with India’s legal regulations, especially in the context of complex cross-border investments?

    The Modi Government has streamlined things for foreign Corporations and foreign Investors to set up their businesses in India. However, there exists the ease of doing business in India, yet in some places, it still needs improvement. For India Business Entry/India Market Entry, we work in close liaison with the foreign Attorneys and CPAs of our client and ensure they understand the legal, financial and taxation related compliances before sharing them with the Directors and Founders.

    Undoubtedly the Indian legal system and the tax regime stands deeply embedded with complexities and the same needs to be dealt with a lot of caution and care. Now from an Investor’s point of view he/she does not want to involve themselves into such complexities. Here comes the challenge, to balance out compliances and investments. The entire process involves numerous and tedious rounds of dialogues and discussions before a consensus is reached. Once we are on the same page then the actual work commences. Over here I would like to thank our Associates and Partners for their commitment and long-standing support.

    What advice would you give to aspiring legal professionals who wish to follow a career path similar to yours?

    Young and aspiring legal professional should always substantiate their words and work with proper research. They should decide which practice area of law they want to work in and then put their heart, body and soul into it, and success shall definitely come to them. In the initial three years of career, they should concentrate on learning over earning. Once they are able to attain top notch skills and decide their practice area and career path then earnings shall eventually follow. Next best thing is to team up with likeminded people and work in conjoin and commence practice. Legal profession in a dynamic profession and is ever evolving and thus one needs to be always thorough and updated with all the requisite skills i.e. legal skills, IT skills etc. in order to achieve the desired goals and to remain relevant. One cannot afford to lose relevancy because irrelevant people don’t matter to anyone.

    Given the demanding nature of your work, how do you manage to strike a balance between your professional responsibilities and personal life?

    A work-life balance is important, but many times it is hard to maintain. The legal profession is always very demanding and time is of utmost essence. There is no straight jacket formula for work-life balance, but for me, short trips in 3-4 months are mandatory. Indeed, it is very difficult to maintain an adequate work life balance and especially when you are working on maximum time zones yet endeavours are definitely made to attain equilibrium. I cannot say that I am perfectly able to maintain a work life balance but I can definitely say that I love doing my work to the fullest and am happily enjoying my life. Yes, sometimes there are ups and downs but they are necessary for a joyful living as things will become monotonous. The basic idea is to enjoy work and life together.

    Starting your career as a first-generation lawyer, can you share a bit about your journey and what inspired you to pursue law as a profession?

    My fascination with the legal profession stemmed not from its prestige or the challenges it posed, but from the unique chance it gave me to explore the complexities of various businesses and industries. Each case was a new puzzle, and every law was a gateway to understanding a different aspect of the world through a legal perspective. Embarking on this path as a first-generation lawyer was both thrilling and intimidating. As an avid movie enthusiast, I rarely miss any film, often spending my weekends catching a late-night show. This passion for movies offers a delightful way to recharge. Along with my love for movies, music is also a big part of my life. I often play the guitar to relax and find peace in the middle of my busy work as a lawyer. Additionally, I have a profound love for driving, though I steer clear of Delhi’s traffic. During court vacations, I’ve embarked on drives to Leh and Ladakh, Manali, and other serene hill stations. These hobbies not only help me unwind but also keep me connected to the creative and adventurous aspects of life, providing a harmonious balance to the rigor of law.

    Could you please share with our listeners how your journey in law began? What inspired you to pursue B.Sc. LL.B. (Corporate Law Hons.) from the National Law University, Jodhpur?

    It’s a fairly interesting story. To be true, being from a family of lawyers and judges, my father never wanted me to be a lawyer. For the final two years of my schooling I was preparing for engineering and did not even fill the forms for law entrance examinations. After clearing the entrance test for Engineering, while depositing the fee in an engineering college in Bangalore, I felt that I don’t want to be an Engineer and rather, want to become a lawyer. Hence, I requested my father to not deposit the fee and expressed my willingness to prepare for the law entrance examination. Being from Rajasthan, NLU Jodhpur was my first preference and luckily, I cleared the entrance next year. 

    Your experience spans both litigation and corporate law. What led you to choose a career path that includes extensive practice in the Supreme Court and various other courts and tribunals?

    After my graduation from NLUJ, I was fortunate to get placed with Amarchand Mangaldas, Mumbai. I was part of the Funds Team and was involved in structuring venture capital funds. One year in Amarchand gave me hands-on experience and confidence to take up corporate work which would benefit me later in my career. However, I couldn’t see myself doing only corporate work for the rest of my life and shifting to litigation was better sooner than later. I therefore shifted to Delhi and started with a litigation journey. 

    Beauty about having an independent practice is that one is not confined to a particular forum or field of law and can push boundaries. Delhi being hub of litigation work, there are ample of opportunities in various courts and tribunals. One has to rather restrict himself from taking up work in multiple forums. I try to confine myself to the Supreme Court, but work naturally spills over to the High Court and various Appellate Tribunals. 

    You’ve worked in diverse areas such as banking, arbitration, constitution, consumer, debt recovery, and more. Could you elaborate on how you found your niche within the legal profession and the areas that resonate with you the most?

    Trend lately has been on super specialization in law. The law firms have dedicated teams to handle one subject or even one area of the subject. This trend is seen more in Tier-1 and Tier 2 law firms.  While specialization is necessary, I strongly believe this approach is prejudicial to the interest of fresh graduates or ones with a couple of years of experience.  In my view, any young lawyer should not specialise at an early stage of his career, rather a lawyer should have an experience to deal with as many subjects, fields and branches of law as possible. It not only gives an overall better understanding of law but also gives the ability to apply principles, precedents, and concepts from one field to another. Interplay of various subjects of law is an important tool which needs to be understood and applied both in courts and while undertaking advisory work. 

    I encourage my juniors to take up matters across various forums and subjects and not confine themselves to any particular field. While allocating work as well, I  ensure that my team gets to work on different subjects. I believe it not only helps them to have confidence in undertaking new assignments but will also aid them later on in their career.

    From being an associate at Amarchand Mangaldas & Suresh A. Shroff & Co. to becoming a partner at Pricus Legal LLP, can you discuss the pivotal moments and experiences that shaped your career trajectory?

    Getting through Amarchand in college placement was one of the most memorable moments of my life. It was nothing short of a dream coming true, and of course it was financially highly rewarding. I was awed by the corporate culture, high profile clients and of course the stakes involved. However, having worked there for a year, I couldn’t find my calling in corporate work. As a result, I took the difficult decision of resigning from the firm and shifting to Delhi.

    I was fortunate to get a chance to work in the chamber of Mr Parag Tripathi, Senior Advocate, who was also Additional Solicitor General of India at the time. He is one of the finest orators and sharpest minds in the legal fraternity. I am proud to be part of his chamber and couldn’t have prayed for a better ‘Guru’. Working in his chamber gave me a chance of working on thousands of cases. Every day over 20 matters were listed which were split amongst 4–5 juniors. On an average each junior had to brief sir in 4 to 5 cases everyday. Every briefing used to be like a short moot court for us where we had to be ultra precise and to the point in our briefing yet making sure we don’t miss out anything relevant and at the same time answer a volley of questions. Doing this for nearly 4 years prepared us well for anything the future had to offer. 

    I took yet another difficult decision to leave the chambers of Mr. Parag Tripathi and started my practice in the later part of 2012. Subsequently,  I also cleared the Advocate-On-Record exam in 2015. 

    Having handled litigation both for individuals as well as companies, over the years, I started getting corporate advisory work as well. As we were getting corporate advisory and transactional work alongside litigation, we decided to formally incorporate Pricus Legal LLP to better manage and handle corporate work.

    Being from a litigation background, I find that the way a litigating lawyer perceives things even in any corporate transaction or documentation is very different from a corporate lawyer. Experience in litigation comes in handy to foresee possible disputes and loopholes. Therefore, as a matter of practice in our firm all corporate advisory/transaction has to go through the litigation team as well.

    As a registered Advocate-on-Record in the Supreme Court of India, you have been involved in several landmark judgments. Could you share one or two cases that you found particularly challenging or significant in your career?

    An interesting case which comes to mind is that of Bhagwan Singh v. Dilip Kumar where son of sitting MLA was involved in gang rape of a minor and was granted bail by the High Court on the ground that FIR was lodged nearly over a year after the incidence and there was no direct evidence to connect the accused with commission of alleged crime. I was representing the minor victim who approached the Supreme Court against grant of bail by the High Court. We were able to persuade Hon’ble Supreme Court to set aside the bail on the ground that High Court can’t look into the evidence at the stage of bail and should confine itself to criteria like seriousness of offence, statement of prosecutrix, likelihood of influencing the trial et cetera while deciding the bail. Judgement makes an interesting read.

    Another decision which I recollect is that of Ravi Khandelwal versus Taluka Store in which we challenged an order passed by the Larger Bench of the High Court in a reference involving question of interpreting Section 14(3) of Rajasthan Rent Control Act which provided a protection to the tenant against any suit for eviction for the first five years of tenancy. The Supreme Court overturned the conclusion of Larger Bench of High Court holding that even if a suit is filed within five years of commencement of tenancy, but during the pendency of suit five years lapse, the defect in the suit stands cured and the protection granted is achieved. However, what was more interesting was that the Hon’ble Supreme Court directed eviction of premises directly even when the appeal of the tenant was pending before the Single Judge of the High Court. Direction of eviction directly by the Supreme Court even while appeal on merits was pending before the High Court to my mind is unprecedented.

    You’ve been a panel lawyer for various esteemed organizations. How did these associations come about, and how does being a panel lawyer for such entities impact your legal practice?

    Getting any panel is fairly difficult, particularly in initial years of practice. Working in the office of ASG, all of us were empanelled with the Union of India which opened the doors for panels of other PSUs. One panel thereafter led to another over the years. Even though these panels are not usually financially very rewarding, they give an opportunity to appear and argue before the court and provide a constant source of work. In initial stages when individual clients are scarce, panel work comes in handy and ensures regular appearances before the court. 

    With your extensive experience in various legal domains, including banking, insurance, constitutional law, and more, how do you balance staying versatile with the need for deep specialization?

    There is a saying that clients choose lawyers specialization. As I mentioned earlier, I strongly believe that lawyers, particularly in litigation, should not get specialised early in their career. It is only after a few decades of practice and incidentally handling a particular kind of cases more than others, that lawyers would get specialised on their own in a particular field. Personally, I would any day choose to do a variety and different kind of work every day rather than get super specialised in any particular field. One of the reasons why I shifted from corporate to litigation was to do a variety of work, but I think that’s a very personal choice.

    Lastly, considering your journey and achievements, what advice would you like to give to fresh law graduates who are about to embark on their legal careers? What are the key lessons you’ve learned that you would like to share with them?

    I would strongly advise young lawyers to explore different fields of law for the first few years of their career before choosing and settling into one which matches their aptitude and liking. Fresh graduates should not be reluctant to change their field, particularly in the first few years of their career and do something which they can call their calling. As one progresses into his career it becomes exponentially difficult to venture into these experiments.

    I also highly recommend that every fresh graduate should start his career with litigation and rough it out in courts at least for sometime. It is only then one understands actual application of law and gives a perspective completely different from mere theoretical understanding. Even if eventually, they decide to move into a corporate setup, the experience in litigation will give them immense confidence. Getting into a super specialized team right out of college is not something I would recommend. Legal Profession is not a 5 year long but a 50 years long career and the initial few years should be an investment on oneself.

    Can you share with us your journey and what inspired you to pursue a career in law, especially with your impressive academic achievements?

    Like many others, I was once keen on cracking the UPSC exams and making my mark as an IAS officer. I was told by my family and friends that attempting the UPSC with law as a subject paper would make things easier. This made perfect sense. Law is after all a key pillar of governance, and I believed that having a degree in law would naturally give me an edge over my competitors when attempting the UPSC exams. So to my mind, the law was simply a means to an end at first. This is by no means to say that I did not take my CLAT preparations very seriously. I moved to ISC from the State Board after Class X as I felt this would allow me to pursue subjects that were more relevant for CLAT with more rigor. I also signed up for CLAT coaching classes, and gave it my best to make it to a good law school. 

    My larger goal of clearing the UPSC did not waiver, that is until I actually started law school and fell thoroughly in love with the law. I was awed by this complex network of norms that held the social contract together while leaving enough room for clever interpretations and mental gymnastics that it never became tedious. I lost myself in my textbooks and lectures, spending hours at the university library to soak in as much as I could of what the law had to teach me. I soon realized that the law was no longer something I had to do, but something I wanted to do. Once this realization hit, I never looked back.

    As for my “academic achievements” as you call it, I believe they are the by-products of  two things. First, a genuine fondness for what I do, and second, discipline / hard work. I also believe that consistent performance, be it at academics or any area for that matter, is just as important as excellence. Consistency takes determination, and a willingness to commit continuous effort to whatever one does. This belief has helped me stay focused not just in my academics, but also in my work.

    You’ve had a diverse range of experiences, from working at a prestigious tax law firm to handling various civil and commercial matters. What prompted you to establish your independent law practice in 2019?

    It was in my first year of law school, when I participated in the Nani Palkhivala Direct Tax Moot in Mumbai, that I was drawn towards tax law. This led me to pursue an internship with Lakshmikumaran & Sridharan in my third and fourth years, when I was fortunate enough to be offered a PPO. The time I spent at LKS in the formative years of my career was crucial, as it concretised my affinity towards tax law and ensured that it would remain one of my core practice areas. My subsequent stint reading for the BCL at Oxford University considerably broadened my professional horizons and opened my eyes to the fact that I need not pigeonhole myself into any one branch of law. The course structure allowed me to craft a cocktail curriculum for myself comprising among other things finance, trade, and comparative corporate law, which prompted me to look beyond my interest in tax when charting my career trajectory. My internship with Mr. Philip Baker, QC, served as a reminder of the adrenaline rush that came with running a well-researched and well-presented matter, and rekindled my interest in litigation. Upon my return to India, I spent some time learning the ropes of litigation at the chambers of Adv. C.K. Nandakumar (now a designated senior counsel), where I also learned invaluable lessons on running an independent law practice. From there, establishing my own chambers seemed a natural progression and I was able to fulfil that dream in 2019 – thanks in no small part to the blessings and support of my wonderful group of family, friends, seniors, and colleagues. 

    Your practice covers corporate insolvency, property, tax, and other commercial and civil matters. Could you give our listeners some insight into the unique challenges and rewards of handling such a wide array of legal areas?

    There are moments when I identify all too well with the adage “jack of all trades and master of none” as a general practitioner, given the sheer scope of work. Apart from needing strong foundations in all areas in which you practice, you also need to constantly stay on top of domain developments – be it a landmark judgment settling (or-unsettling) a substantive question of law, or an obscure circular from a local authority that manages to make existing workflows obsolete in one swift stroke. Many colleagues also argue, perhaps rightly so, that the world is heading towards super-specialization. Increasingly complex problems call for increasingly complex solutions, and some say that it is simply too difficult if not impossible to gain the required level of insight into multiple domains at once.

    However, for every moment of uncertainty, there are two others to remind me that there is still immense value in what we do. It is always an advantage to have a 360-degree perspective on briefs, as it helps avoid situations where you win the battle in one forum yet lose the war in another. Such a perspective only comes with experience gained by handling matters across domains and forums. We also do not work in silos and make it a point to enlist the help of domain experts as and when required.

    In addition, and most importantly, the subjects we handle are all interconnected at various levels. It is not possible to practice say corporate or commercial law without having a good grip on property and tax law. Ultimately, what makes a good lawyer is their innate understanding of how people work and think. The broader your sense of how and what makes the world tick, the more effective you are as a lawyer. 

    You’ve represented both government and non-governmental organizations, as well as tier 1 and 2 law firms. How do you adapt your approach when working with different types of clients and organizations?

    Every client, whether a government organization or a business, has a set of attributes that is unique to them. This could be their nature of work, familiarity with the legal system, reporting requirements, personal convictions – the list goes on. There are some clients who need to be sat down and patiently walk through their legal strategy many times over, while there are others you may not meet in person at all and with whom you interact only when strictly necessary. Needless to say, a one-size-fits-all approach will not work here and you are expected as a lawyer to tailor your approach based on the unique attributes of the client as well as the matter at hand.

    While the specifics may vary, there are some aspects of client relationships that stay the same irrespective of the client. For instance, I make it a point to handle every client with a high degree of professionalism, always respecting the human element behind each litigation. I do not differentiate my clients on an interpersonal level based on where they come from or what their background is. Lessons learnt from working with some clients can also be transposed to others, making the overall processes stronger. 

    As a guest lecturer at several universities and a guest editor for peer-reviewed journals, you’re deeply involved in legal academia. How do these roles complement your legal practice, and what do you enjoy most about them?

    While I have carried forward an interest in legal academia from my law school days, I am not sure it would be accurate to call me “deeply involved” at this point, as time and bandwidth constraints have certainly impacted my involvement. In the past, I used to be a frequent contributor to my university law journal and newsletters, as well as some external publications. We had an in-house knowledge building team at LKS, whose high-quality content kept us young lawyers on our feet and up to date. At Oxford, I was part of the South Asian Political Thought Discussion Group and occasionally coached younger students for moots and peer-reviewed their papers. I still receive invites to deliver guest lectures on tax and insolvency law from time to time and speak at various events / platforms. 

    I believe it is important to keep in touch with legal academia in whatever limited way our work schedule permits. Making time to read the right literature and also interact with students and other academicians will go a long way in strengthening one’s knowledge pool, particularly on aspects one may not routinely encounter in the course of work. As the rush from one matter to the next rarely leaves room for creative thought or knowledge-building, it becomes necessary to find other ways to organically stay in touch with academia. This could even be something as simple as setting aside time to discuss learnings with peers and colleagues.

    You’ve been recognized with awards such as the “Emerging Women’s Leader” award. What do you believe contributed most to your success, both academically and professionally?

    Success in any field in my opinion is largely the product of three things – determination, hard work, and consistency. If you give enough time and commitment to anything you do, success will find you sooner or later. Cliched as that might sound, I can say from personal experience that the formula does work. I had my priorities well-set from a very early age and was highly driven to be good at whatever I did. I knew my strengths and weaknesses well, and I put in as many hours as it took to get the results I wanted. I was also fortunate to have a good support system of family that helped me however they could, especially my parents, my husband and one particular maternal uncle, be it through words of encouragement to inspire me or objective reality-checks to keep me grounded. 

    In your impressive list of publications, you’ve covered topics ranging from tax law to arbitration. Could you highlight one area of law that you’re particularly passionate about and why it matters in today’s legal landscape?

    Although I have written on a variety of matters in the past, they have all largely been the outcome and logical extension of some litigation or advisory opinion that I have rendered. This is an unfortunate reflection of the reality that litigation leaves very little time to focus on other areas of interest.

    That said, if I were to highlight one area of law as my favourite, it would have to be insolvency and bankruptcy law. As an office, we handle matters under the IBC across all forums, from the NCLT up to the Hon’ble Supreme Court of India. This has given us a well-rounded and elaborate perspective in handling complex IBC matters. Our interactions with a variety of stakeholders including shareholders, directors, creditors, resolution professionals / liquidators and others in the system have not only helped us better understand the commercial motivations behind many decisions made in the IBC space, but they have also given us the ability predict with some accuracy the roadblocks in a resolution / liquidation process and plan around them. India’s experience with insolvency and bankruptcy may still be maturing, but I very much look forward to continuing my work in this evolving domain.

    Given your extensive experience in the legal field, what advice would you offer to recent law graduates who are just starting their careers and navigating the legal profession?

    As a first-generation woman lawyer, I was told at various points throughout my journey that the road ahead would be more than a little challenging. When I left my plush corporate job and set out to read for the BCL and thereafter, came back to India to be a full time litigator, there were several well-wishers who gave me similar caveats about the transition to litigation. I can now say with the benefit of hindsight that they were not wrong. There is a lot of struggle and even more uncertainty, especially as an independent practitioner. In my initial years of independent practice, the lack of definite answers like where / when / how will the next brief come if they come and will they pay, were all very unsettling. And very honestly, they still are.

    What I was not told enough however, was how rewarding an experience it is to brave the storm and watch yourself grow into the lawyer you always wanted to be. It is in fact the years of struggle that taught me to trust myself better. I took many leaps of faith, some small and some big, I made mistakes, learned from my mistakes, sought help and gave help where I could, and made it my life’s mission to pursue my dream of becoming a good lawyer. I will take the very fact that I am speaking to you now as proof that all the time and effort put in over the years did pay off. 

    This would be my advice to my future colleagues who are just stepping into the legal profession as well. You have chosen a career full of promise and intrigue. The road to success may be more treacherous for some of you than others, but it will not be easy for anyone. The law truly is a jealous mistress, and will demand all the attention you can give. However, if you give it the attention it deserves, the sky’s the limit. Take the time to introspect and know the direction you wish your career to go, keeping in mind that there always is room to reorient down the line. Once you have this clarity, work with an office that teaches you not just the subject but also the smaller life lessons that will help you in your career. Build a robust network of friends, colleagues, and acquaintances, as the importance of reputation through word-of-mouth cannot be overstated. Last but not the least, never stop learning. There is an ocean of knowledge available at your fingertips – make good use of it.
