    Reflecting on your journey, what initially drew you to pursue a career in law, and what inspired you to choose this path? Could you share some of the challenges you faced during your early days in the legal profession and how you overcame them? 

    My first inspiration towards the legal profession came from my father who himself was a lawyer and practiced income-tax for a few years in Jammu and Kashmir. While my father’s initial footsteps were in law, he eventually transitioned to the family business of manufacturing high tension aluminum wires. However, he would always lovingly recount memoirs and anecdotes from his practice days and would consistently motivate me to take up law as a profession. From a very young age, I was exposed to the intricacies of the legal world through his work, experiences and stories. His influence remained a constant in my life, serving as a beacon of inspiration as I forged my own path in the legal profession. His commitment to integrity, diligence, and service instilled in me a deep respect for the law and a desire to become a lawyer.

    Entering the legal profession, I encountered a range of challenges typical of any newcomer to the field. One of the most significant hurdles was navigating the transition from academic halls of college to practical application of law in Courtrooms. The theoretical knowledge gained in law school provided a solid foundation, but applying that knowledge in real-world scenarios required a different skill set altogether. Be that as it may, I guess I always had the vision and belief in myself to navigate these challenges. Even though I come from a small town, Jammu, I decided to practice in the capital of the country, which offers the best exposure to fresh law graduates. I was never attracted to practice in the comfort of my hometown. 

    Another challenge was building credibility and establishing myself within the legal community. As a young lawyer, earning the trust of seniors, clients and colleagues was quintessential for success. I faced skepticism and uncertainty from some quarters, but I approached each interaction with unwavering professionalism, competence, and a commitment to excellence. Over time, through hard work and dedication, I earned a reputation for integrity and competence, gradually gaining the confidence of those around me.

    Despite these challenges, the inspiration that I drew from my father’s example kept me focused and motivated. His unwavering support and blessings and belief in my abilities gave me the strength to persevere during the tough times and celebrate the victories along the way. Reflecting on my journey, I am grateful for the foundation he provided and the lessons he imparted, which continue to guide me in my career as a lawyer.

    Your journey from Associate to founding your own full service law firm, i.e., Expert Legal Services is inspiring. What personal qualities or characteristics do you believe played a significant role in your career progression, and how do you nurture these traits in your team members? 

    Reflecting on my journey, I believe that humility, focus, hard work, attention to detail, approachability and giving precedence to the interest of the client have been the core tenets of my practice. I cannot single out any one quality that helped in my career progression and it is always the right mix of attitude, aptitude, luck and hard work that helps you grow.

    While mentoring my team members, I focus on their all-round development. I give them exposure to deal with clients independently under my supervision and to argue matters before various forums. This provides them with the much-needed exposure and also helps them in learning from their own mistakes and enables them to think on their feet. I always tell them to learn from their lows and to perform better. I am otherwise, in my peers’ view, an easy going and jovial person. This in my view helps them to perform without any stress and anxiety and to give their best in everything that they do. I also encourage open communication and constructive criticism. By fostering an environment, based on core values, we promote collaboration, respect, and continuous growth within our team.

    Given your expertise in litigation, could you share a memorable anecdote that exemplifies the dynamic nature of legal advocacy and the importance of quick thinking under pressure?

    I believe every day in court brings new lessons and stories. Through divine grace, I have been blessed with the opportunity to represent clients in diverse jurisdictions, providing me with first hand insight into the dynamics of these various courts across India. I believe that preparation and patience are the key virtues for any litigation lawyer. You may not get favorable orders everyday and therefore, you should carefully weigh all factors and avoid pushing your luck.  

    While there are many instances in my 17 years of practice, a recent incident that vividly comes to my mind, where a case demanded urgent interim protection for our client in securing a disputed amount. The opposing party was in the process of winding up their operations in the country and therefore, swift action was imperative. We immediately approached the court  and recognizing our urgency, the court directed the party to obtain prior permission before parting with their assets in India. At the end, we had a very happy and contented client. 

    Instances like these are the heartbeat of daily courtroom engagements, offering invaluable learning opportunities for legal practitioners at every level. In the realm of law, growth is perpetual, and each day brings forth new lessons to enrich our understanding.

    Your clientele includes renowned fortune 500 companies spanning different industries. What are some common legal issues or trends you have observed across these sectors and how do you tailor your approach to address their specific needs? 

    In my experience, serving a diverse clientele across various industries has exposed me to several  legal issues and trends. Every industry has its own set of issues and there is an overlapping legal trend as such. Consequently, there is no one-size-fits-all solution when it comes to addressing these diverse challenges. As a lawyer, it is our responsibility to tailor our approach to each unique situation, providing customized solutions that best align with the specific needs and circumstances of our clients.

    One requires a comprehensive understanding of both the legal framework and the practical realities of the business world, to successfully cater the needs of any client. At Expert Legal Services, we try to achieve the best possible outcome for the client while ensuring compliance with legal requirements and ethical standards. Cultivating an approach that prioritizes innovation, collaboration and problem-solving, has helped our clients succeed in an ever-evolving business environment.

Can you share a lesson or mentorship experience that significantly influenced your legal career?

    Certainly, being associated with esteemed legal luminaries like Senior Advocate Mr. Amarjit Singh Chandhiok, Senior Advocate Mr. Siddharth Luthra and Mr. Raian Karanjawala has provided me with invaluable experiences that have profoundly shaped my legal career. These experiences have instilled in me values of perseverance, decision making, hardwork and efficiency. From understanding the minutiae to grasping the broader legal implications, I have learned that attention to detail is of paramount importance. Moreover, the significance of punctuality has also been deeply ingrained in me. 

    One important lesson that I learnt from Mr. Chandhiok was that a good lawyer is one who is not impacted by the outcome of the case. One should always give their best and leave the rest to the judge. 

    As someone deeply entrenched in the legal domain, how do you maintain a work-life balance amidst the demanding nature of the profession? Are there any mindfulness practice or routines that you find particularly beneficial in managing stress and staying focused?

    Balancing work and life in the legal profession, especially in litigation, is indeed a constant juggle. While striving for equilibrium between professional demands and personal well-being, I’ve found that maintaining a structured approach to my workday helps manage this delicate balance. Each task is allocated a specific time slot, allowing for a more disciplined workflow.

    However, the unpredictable nature of legal practice means that flexibility is key. Clients may require urgent assistance at any hour, whether it’s seeking bail or filing a habeas corpus writ. In such instances, attending to these immediate needs takes precedence, often disrupting planned schedules. Nonetheless, amidst the demanding nature of the profession, I make a conscious effort to carve out time for personal pursuits and family. Engaging in hobbies or spending quality time with loved ones serves as a crucial counterbalance to the intensity of legal work.

    Your expertise in navigating anti-bribery and anti-corruption investigations is commendable. What proactive measures do you recommend to prevent such occurrences in businesses?

    To overcome illegal practices, I always advice clients to follow best practices and confirm to ethical standards. It is also important to introduce a system of checks and balances for early detection of any such occurrences.  Swift Action can help the companies to minimize the impact and nip such instances in the bud. Though, one cannot guarantee against any possible leaks but in my view, this shall considerably safeguard the exposure to a significant extent.  

    Beyond legal practice, you’re known for your philanthropic efforts. How do you integrate social responsibility into your professional life, and do you believe there’s a symbiotic relationship between community engagement and legal advocacy?

    Compassion, generosity and large heartedness are again virtues that I have inherited from my parents. Their dedication and persistent desire to help others has left a profound impact on me. I was always taught to help the poor and the needy. This is an extremely relevant trait that I also wish to pass on to my daughters. I also believe that being an advocate comes with a profound responsibility to serve the less fortunate, especially within the context of the legal system. 

    At our firm, we prioritize social responsibility and actively integrate it into our daily practice. We are committed to serving not only our well to do clients but also individuals and causes that may not have the means to afford legal representation. We are engaged in various pro bono matters, dedicating our time and expertise to assist marginalized communities, champion social justice causes, and address systemic inequalities. To give an example, we recently assisted a young boy who had been charged under POCSO and was languishing in jail and helped him in securing bail from the High Court.  I see a clear symbiotic relationship between community engagement and legal advocacy. Our involvement in the community fosters trust, builds meaningful relationships, and amplifies the voices of those who may otherwise go unheard. 

    You’ve been instrumental in mentoring young lawyers throughout your career. What advice do you impart to aspiring lawyers entering the field today, and what qualities do you believe are essential for success in the legal profession? 

    Certainly, mentoring young lawyers has been a rewarding aspect of my career, and I’m always eager to share insights with aspiring lawyers entering the field today. My advice to young lawyers is that success is not an overnight journey and requires considerable hard work, toil and burning the midnight oil. The key to success lies in developing expertise and being consistent and punctual in your work. Invest in your work and you’re bound to reap success. Also, it is important to realize that one should not get disheartened by adversities and remember that the castle of success is not built on victories  but on failure.

    You’ve had an impressive journey in the legal field spanning over three decades, with experiences ranging from trial court practice to senior partnership at leading law firms. What initially drew you to pursue a career in law, and how did your early experiences shape your path?

    To tell you what drove me, or what motivated me, to pursue a career in law can be an obvious answer but still it requires a bit of self-reflection. My passion for law and interest in becoming a lawyer came largely from it being intellectually challenging. I was perhaps also passionate about legally connected issues during my school and college days. My father being a lawyer and my interest in watching movies and reading crime fiction also contributed a bit in my desire to become a lawyer. Moreover, to be honest, with little understanding of science and lack of interest in accounting and management professions, I was left with just a few options and law was one of them. 

    I’m normally quite a private person, so my journey as a lawyer wasn’t quite easy. As a ‘baby’ lawyer, I worked across many different areas of law. I was fortunate enough to have some amazing experiences very early in my career on a variety of issues including family laws, labour laws, consumer laws, criminal laws, revenue laws and property matters. While the thrill of being in district courts of my small hometown and learning so much in one go was amazing, it just wasn’t the same as practising in a large city in a professional environment with matters having substantial stakes. I then moved to Delhi and have since then practised all kinds of business and corporate laws across different practice areas. 

    Your expertise encompasses various legal domains, from dispute resolution to intellectual property rights. Could you share a pivotal moment or case in your career that significantly influenced your approach to practicing law or shaped your specialization?

    During the initial years of my law practice, I got an amazing opportunity to work on a complicated matter which required substantial skills in a variety of laws including intellectual property laws, trade and contractual issues, criminal laws, foreign collaboration laws, government policies and tax laws as well as skills in court litigation and arbitration. It is then I realised that complexity requires teamwork and collaboration. In order to manage client matters effectively and efficiently, lawyers have to utilize a more diverse group of skills and people. What is also clear is that teamwork and collaboration require heavy doses of trust and shared responsibility. Furthermore, working on this case and many other interesting assignments of different nature ensured that I enjoy offering a range of diverse skills and an intelligent mix of knowledge from a variety of disciplines. 

    As a seasoned business attorney, you’ve worked extensively with multinational corporations, navigating complex legal landscapes across different industries. Could you elaborate on a particularly challenging situation you encountered and how you successfully resolved it?

    Another challenging work situation I encountered during the initial years of my career was when I was assigned a client project with tight deadlines and high expectations. There were several experienced legal teams working on the assignment for different parties from different jurisdictions including India, UAE, Japan and Mauritius. As someone lacking experience, I somewhat struggled with interactions and communication, which made collaborating with diverse teams a bit challenging. However, I soon recognised the importance of effective teamwork and found ways to navigate this situation. To overcome this difficulty, I proactively communicate my needs and concerns to the client and different teams. I asked for clear guidelines and expectations, ensuring that I had a clear understanding of my role and responsibilities. By focusing on my individual strengths, such as attention to detail and problem-solving abilities, I was able to make valuable contributions to the project. This experience taught me the importance of open communication, seeking support when needed, and the importance of meeting small deadlines to meet the primary deadline. 

    Your track record boasts a high success rate and a remarkable ability to manage legal affairs with a commercial mindset. How do you balance legal intricacies with strategic business objectives to deliver optimal outcomes for your clients?

    We live in a world of strategic compliance – or as I like to call it, “Winning at Business Without Landing in Jail.” Gone are the days when legal compliance was seen merely as a back-office function. Today, it is recognized as a key player in shaping business strategies. This shift is partly driven by the increasing complexity of regulatory landscapes across different jurisdictions, especially for global businesses. The rise of technology, data privacy concerns, and the dynamic nature of international trade laws further complicate this scenario. 

    At its core, strategic compliance is about finding a balance. On one side, there are the business goals – growth, profitability, market expansion, and innovation. On the other, there are legal and regulatory requirements, which can often seem like barriers to these objectives. However, instead of seeing these groups as opposing forces, we should focus on integrating compliance into business strategy, thereby enhancing, not hindering, the pursuit of business. 

    In my view, compliance shouldn’t be seen as the party pooper showing up after the decisions are made; it’s part of the party-planning committee, and we need to ensure that the business goals don’t end up with a noise from the legal department. Ideally, in the world of strategic compliance, it’s all about making the law work for you, not against you.

    Throughout your career, you’ve demonstrated exceptional leadership skills by managing teams of attorneys and fostering a collaborative environment. What strategies have you found most effective in leading legal teams, especially in high-stakes situations?

    Becoming more effective in leading a team is certainly more of an art than a science. Often, it can also mean adapting to the team you have or the circumstances at hand. However, the key is to encourage collaboration across people, teams and departments. It is also important to set an organisation vision and communicate the big picture. 

    What will you say on Client Retention vs. Client Acquisition? Where do you think that most law firms go wrong on this? 

    A law firm’s past and existing clients are a huge asset to the firm, so it’s crucial to maintain a strong relationship with them so that they stay loyal and do not leave the firm. And yet most law firms, in particular small to midsize firms, spend most of their marketing budget on finding new clients instead of nurturing the ones they already have or had not too long ago. It is common knowledge that acquiring a new client can cost 5 to 10 times more than retaining an existing client. In my experience, increasing customer retention by 5% to 10% can increase profits from 25% to 100% in mid term. The success rate of selling your services to a client you already have is 50% or more, while the success rate of selling to a new client is just about 10% in most cases. There are some surveys which have found that loyal clients are 5x as likely to repurchase, 5x as likely to forgive, 4x as likely to refer, and 7x as likely to try your new offering, as compared to a new client/potential client.

    What, in your experience, is necessary for a lawyer to stay relevant in the fast changing legal industry? 

    The legal industry is on the verge of a major transition and it has in fact already changed a lot in the last decade or so, which is driven by the introduction of technology. The legal industry is changing because of the introduction of new innovations related to the industry and hundreds of new legal start-ups emerging every year. Today, machine learning is beginning to transform the legal profession in many ways but in most cases it augments what humans do and frees them up to take higher-level tasks such as advising clients, negotiating deals and appearing in courts. In machine learning, computers use an algorithm, analyze data, learn the pattern and glean insights from the data, so a lot of routine or easy work can be taken care of without much involvement of a senior lawyer. Without a doubt, the ecosystem will continuously affect the way lawyers are working and will work in the future. If lawyers learn legal management practice with the latest technology, then only they will be able to survive in the future. 

    Another very important aspect is that the lawyers have to continuously update their knowledge in order to stay relevant. There was a time when lawyers could do well just by having knowledge of general laws of the land or by having understanding of traditional practice areas, like contract law, torts and civil and criminal procedures. That’s no longer the case in view of special laws and tribunals and specialised practice areas that are coming up very fast. 

    Also, I have a strong feeling that lawyers who don’t add value to the client relationship won’t survive in an ever-competitive environment; they will simply become irrelevant. One should therefore be very efficient in delivering the outcome. So get better at management of client assignments. Give commercially pragmatic advice, not just advice that’s legally correct. Keep in touch with the clients regularly with helpful tips and advice, even if you don’t get paid for this. Pass on the knowledge you are getting about their business or industry. Understand clients’ businesses and the industries in which they operate so you can tell them of pitfalls before they arrive.

    A Generalist or a Specialist: What’s the Best Fit for A Lawyer’s Career?

    Personally I have always been inclined to offer a range of diverse skills and an intelligent mix of knowledge from a variety of disciplines. Hence, I have been a generalist lawyer by choice throughout my career.

    Generally speaking, handling diverse roles provides generalists a good understanding of all the functioning parts of the business or industry. Generalists multitask and collaborate to tap into related domains when opportunities arise. This hones their ability to handle unique situations and formulate enduring perspectives. However, there is a limitation in as much as generalists aren’t sometimes that competent in niche projects. Moreover, there is a higher chance of their early burnout as they work across multiple teams and tackle a host of responsibilities, especially if they are in leadership roles. 

    As digital transformation takes the center stage, the generalist vs specialist debate is taking a definitive turn. One should definitely ask oneself the following questions, amongst others, to gain a comprehensive understanding of one’s needs and goal: Do you like a diverse breadth of knowledge or do you prefer deep research on any specific topic? Do you change your career perspective often and prefer taking time to find the niche you are interested in? Or have you already determined your career trajectory? What kind of work ignites your interests and passions? Does it require you to hone different skills or demand specific subject-matter expertise?

    What are the biggest challenges that the legal sector is facing or will be facing in the short to mid term? 

    From economic pressures to cyber threats, lawyers are facing a number of challenges. The economy remains volatile in 2024, marked by ongoing geopolitical tensions. This is making clients even more price conscious when choosing a law firm. There is also an expectation for greater cybersecurity and verifications for online activity as law firms are wary of increased risks of cyberattacks. Most law firms are however yet to implement effective cyber mitigation strategies. Further, even though integrating legal softwares and systems is not a new challenge, it’s increasingly becoming important as law firms strive for increased profitability while improving client service and experience. Talent attraction and retention in the legal sector will also continue to be a significant challenge in 2024.

    Can you walk us through your journey from being an in-house counsel and company secretary to becoming a business leader and now a practicing lawyer specializing in energy and infrastructure?

    Yes, it has been an exciting journey so far. I started as company secretary and became in-house counsel and later on appointed as Head Legal in Fortum India. I had to set up legal, compliance and secretarial practice for businesses ranging from solar & wind projects, acquisition cases for hydro power, waste to energy and laying out EV charging infrastructure. It was a big shift from my earlier role in Schneider Electric and previous organisations. Fortum was a leadership position and businesses were new sun rising sectors in India, like solar and wind, EV, and biorefinery. Regulations are still evolving, hence, I have to push myself beyond legal knowledge, to acquire business and market understanding, which can help me in providing seamless legal support for business growth. I got opportunities for working on land acquisitions, regulatory approvals, funding of projects, selling of assets and a lot of drafting and contracting. All of this developed my understanding of capturing business true intentions into a legal paper and maybe, I started feeling more comfortable with business leadership. 

    After 6 years of leading legal function, got the responsibility as Country Director & Business Head for leading Biorefinery business (or Bio2X as Fortum calls it). It was a completely different role and I have to broaden my thinking. From finding flaws and identifying risks in business proposals, I have to find solutions, resolve issues and manage a big Joint Venture. Completely different work, but I believe my capability of learning fast, with legal knowledge, sector expertise and understanding of board practices helps me. 

    When last year, I joined AKS, as Partner-corporate, energy and projects, I believed that I am perfectly placed to advise my clients with the highest level of legal services and work with required domain expertise of energy sector as well as of projects. I understand the perspective of the in-house team, their business requirements and how to address matters in the energy sector. 

    Your career has seen you working with esteemed organizations like Schneider Electric, Hero Group, and Fortum India. How have these experiences influenced your approach to legal practice?

    I started my career with a couple of Indian promoters driven by mid-size companies and from the last 15 years worked for MNCs like Schneider Electric and Fortum. In mid-size companies, you have opportunities for growing beyond your key responsibility areas, as all the functions are not hard lined. If you have desire, you may take up tasks beyond your key role and that will prove vital for my growth. 

    While working in MNCs you learn the importance of good corporate governance and putting statutory compliances in place. Working with different jurisdiction lawyers helps you sharpen your skills, and gives you a different perspective of thinking about the same issue. Also, I understood how “LESS IS MORE”. How I can plan and strategize my work to become more effective. Like, a legal document need not be lengthy, but sufficient enough to capture business understanding and required legal provisions.

     Your expertise spans a wide range of areas within the energy sector, including renewable energy, EV charging infrastructure, and biofuels. What drew you to specialize in these specific niches?

    Frankly speaking, when I was joining Schneider in 2009, I was going for a big MNC job, without much understanding of a sector specialisation etc. But, as it happened, a lot of contracts, transactions and legal work came through the energy and infra sector, which started developing my interest in this industry. Big opportunity came for me, in the form of a Fortum leadership position in legal, a decade ago. Fortum came to India, with the ambition of replicating their European businesses of Hydro, Nuclear, Waste to Energy etc. As a Legal Head, I had to gather all the possible knowledge and expertise of the sectors my organization was working. This leads to learning and research into specialised fields like EV charging infra, solar & wind, nuclear etc. For a sector, which is developing, you need to be very close to business and keep yourself updated with the latest happenings in the sector.

    Could you share some insights into the process of establishing groundbreaking joint ventures like the one between Fortum & Chempolis and Numaligarh Refinery Limited for the 2G Ethanol Bio Refinery in Assam?

    This one is special, real hard work, not only from legal, but for developing a business case to create a Joint Venture for setting up the first of its kind bio refinery in the world. JV was bringing new technology in India, which was developed in Finland by a company called Chempolis. I was tasked to work on Joint Venture from a legal perspective, and got so involved that I was entrusted with responsibility of leading Joint Venture as Director and key member in high powered committees. 

    Beautiful learning experiences, working between Indian and European Jurisdiction for technology transfer, IPR protection, funding and governance. With the opportunity of developing relationships with industry leaders, learning the whole business ecosystem. Understanding significance of proper documentation, drafting of contracts, resolving disputes along with true understanding of risk identification and mitigation from ground and not only on papers.

    With your extensive experience in setting up solar projects across multiple states in India, what are some of the key challenges you’ve faced in navigating the regulatory landscape and securing investments for such projects?

    The biggest challenge in solar projects across India is acquisition of land, connectivity and uncertainty of regulatory framework. With resolving these three important factors, India will achieve ambitious targets of renewable energy. In one of the projects, between the stage of LOI to signing of PPA, Govt. levied safeguard duty on import of solar panels. Of course, it was covered under Change in Law, but sudden policy changes create hurdles for investments and pose challenges from a legal perspective.  

    As someone deeply involved in the energy industry, how do you see the role of startups and new technology collaborations shaping the future of energy production and distribution?

    It’s like selecting a cricket team. You need a mix of experience and youth to win a championship. If we are looking to solve the biggest challenge of global warming, while keeping the economic pace of India, we require a lot of new technologies and Startups that bring us close to a circular economy. We need new technology in developing green hydrogen, producing batteries with material available in India, utilising biowaste, etc. Without embracing new technologies, we will miss our targets. I personally believe, new technologies with small companies in Europe and other innovative jurisdictions, have great possibility of commercial success with Indian PSUs & Corporate houses. Likewise, India is also becoming a Startups hub and a lot of promising developments are happening. 

    In fact, we at AKS Partners, have a key focus for startups, either Indian or International for providing them, specially designed legal services and in some cases, maybe beyond legal, like connecting right industry players, some funding opportunities with our connection in the sector.       

    You’ve been actively involved in various industry forums and committees, including serving as a member of the Confederation of Indian Industry (CII) National Committee on Bioenergy. How has your participation in these groups enriched your understanding of the sector?

    Absolutely, it has been a pleasure and privilege to be part of these committees and various similar forums, wherein, I got a chance to put my ideas and perspective and educate myself with experiences shared by other leaders. These platforms, like CII National Committee on bioenergy are good forums to deliberate and exchange ideas and make recommendations to the Government for sector growth. In fact, these things prepare you, what is the upcoming trend in the sector. 

    Lastly, drawing from your journey and expertise, what advice would you give to fresh graduates aspiring to build a career in law, particularly in specialized fields like energy and infrastructure?

    First of all, the Indian economy is growing at an unprecedented pace, along with the aspiration of its people and living standards are rising. We are consuming more energy for home appliances, vehicles, data centres, houses, malls, etc. Therefore, the energy sector is going to rise in India. Solar, wind, green hydrogen, electric vehicles will take centre stage, but traditional sources will continue playing their part like Coal, Oil & Gas, etc.  

    To become a specialist in the energy sector, we need to understand the industry in detail. Energy sector is a highly regulated and capital-intensive business. For our clients, or for our organisations, if we are in-house counsel, we need to keep in mind that we are just a notification away from becoming a viable project to unviable business. Therefore, best practices, challenges of the sector, contentious areas and keeping a pace with regulatory development is a must for the energy sector.

    Abhiraj, could you please introduce yourself to our readers and walk us through your journey, from what inspired you to pursue a career in law to where you are today at Deutsche Bank Group company? What pivotal moments or experiences have shaped your career trajectory thus far?

    Absolutely, it’s a pleasure to share my journey. My path into the world of law was somewhat unconventional. I was born and raised in a middle-class family in Samastipur, a small district in Bihar (India). During that time, engineering and medical were the go-to career choices, but I had a different path in mind where I decided to pursue commerce and later aim for CA, steering away from the mainstream. 

    While gearing up for a CA course in Delhi after my 12th board exam, a chance encounter with Chanakya National Law University advertisement in a newspaper changed everything. With my father’s attention drawn to that advertisement and his subsequent encouragement, I decided to give it a shot, despite doubts. Surprisingly :), I cleared the exam, prompting a last-minute decision to pursue law instead of commerce. Thus began my journey into the legal realm in 2006 and subsequently earned my law degree in 2011.

    Law school was an amazing time for me, packed with fun, studies, and a range of extracurricular activities. From internships to various co-curricular endeavors, these experiences not only enhanced my understanding of the law but also helped shape my character and confidence in this field.

    Transitioning from academia to the professional sphere wasn’t easy, especially as a first-generation lawyer. After gaining insights into court procedures at a boutique law firm for about a year, I made my foray into the corporate world, beginning my journey at UnitedLex Corporation. There, I honed my skills in contract drafting, vetting and negotiation for their Fortune 500 clients, eventually transitioning to in-house counsel roles at MNC’s like Pearson, Randstad (seconded to Idemia), MPS Ltd. I have acquired extensive and varied experience during my tenure at these companies, spanning across various facets of law and industries. This includes, but is not limited to, managing and supporting legal functions encompassing advisory services, litigation and arbitration, legal & regulatory compliance, Intellectual Property Rights (IPR), contract management, acquisitions, stakeholder management and other corporate matters. Today, I find myself at Deutsche Bank Group company, where I am fortunate to apply my legal expertise in a dynamic and challenging environment. My role here as a Technology, Regulatory & Privacy Lawyer allows me to not only navigate complex legal landscapes but also contribute to strategic decision-making processes that drive business success in a global market. 

    In short, I can say that each step has been filled with challenges and learning opportunities, supported by colleagues and mentors along the way. Throughout my journey so far, pivotal moments and experiences have played a significant role in shaping my trajectory in the field of law.

    Your journey seems incredibly diverse, from legal counsel to data protection officer. How did you transition into your current role at Deutsche Bank Group company, and what inspired you to specialize in technology and data protection law?

    My journey has been quite varied, indeed. Transitioning into my current role at Deutsche Bank Group company was a result of my passion for technology and data protection law, coupled with my background in legal counsel. Over the years, I’ve been increasingly drawn to the intersection of law and technology, recognizing the critical importance of data protection in our digital age. This led me to pursue additional training and certifications in data protection and privacy, equipping me with the necessary expertise to transition into the role of a Data Protection Officer. The opportunity to work at Deutsche Bank Group company presented itself as an ideal platform to apply my skills and knowledge in a dynamic and challenging environment, where data protection is paramount. 

    For this, I would like to express my gratitude to my current company for providing me with the opportunity to learn and grow in the field of data privacy alongside with my responsibilities as legal counsel where I am currently providing strategic legal advice and support in relation to legal topics and issues around technology and outsourcing regulation, data protection, intellectual property, contracting, and related areas impacting bank business in the region. In addition, I also support the management of legal, regulatory and reputational risk in outsourcing and tech-related transactions.

    We noticed you’re passionate about technology. How do you see emerging technologies like AI, Blockchain, and Big Data impacting the legal landscape in the future?

    Technology is a great teacher. It constantly teaches us that change is the only constant in the evolution of technology. Over time, new technologies replace old ones, which can bring new problems and challenges. New technologies are constantly pushing the boundaries of the law and therefore lawyers and legal professionals around the world are witnessing significant changes in the way they practice law, thanks to innovations like artificial intelligence, blockchain, and data analytics.

    Emerging technologies such as AI, Blockchain etc. are poised to revolutionize the legal landscape in numerous ways:

    • AI in Legal Research: AI-powered tools can sift through vast amounts of legal data in seconds, significantly expediting legal research and document review. 
    • Predictive Analytics: By analyzing past case outcomes and legal trends, AI can predict potential outcomes of ongoing cases, enabling lawyers to make more informed decisions and develop stronger strategies.
    • Automating Routine Tasks: AI-driven automation can support repetitive tasks at preliminary stages like contract review, document drafting, and due diligence. This allows legal professionals to focus on higher-value activities that require more human judgment and creativity.
    • Data Analytics for Case Management: Big Data analytics can extract valuable insights from large volumes of legal data, helping lawyers identify patterns, assess risks, and optimize case management strategies.

    Overall, the convergence of AI, Blockchain, and Big Data is set to transform the legal profession, driving efficiency, reducing costs and providing new avenues for innovation. 

    In my opinion, while emerging technologies may reshape the legal profession and alter the nature of legal work, they are unlikely to eliminate the need for skilled legal professionals altogether. Instead, they will complement lawyers’ capabilities, create new opportunities for specialization, and require continuous adaptation and upskilling to thrive in the evolving legal landscape.

    Beyond your professional achievements, we hear you’re an avid traveller. How has exploring different cultures influenced your perspective, both personally and professionally?

    Certainly! Exploring different cultures through travel has been an enriching experience that has shaped both my personal outlook and professional approach in several ways.

    On a personal level, immersing myself in diverse cultures has enriched my understanding of the world and broadened my horizons. Experiencing new cuisines, customs, languages, and traditions has fostered a deep appreciation for the richness and complexity of human society. It has taught me to approach unfamiliar situations with an open mind, curiosity, and respect for cultural differences. Moreover, interacting with people from diverse backgrounds has helped me develop empathy, tolerance, and a global mindset.

    Professionally, my travels have enhanced my interpersonal skills, adaptability, and cross-cultural communication abilities. Working in a globalized world, where interactions with clients, colleagues, and stakeholders from different cultural backgrounds and jurisdictions are increasingly common, these skills are invaluable. Moreover, exposure to diverse perspectives and ways of thinking has fueled creativity and problem-solving in my professional endeavors.

    You’ve worked with both law firms and in-house legal departments. How do these experiences differ, and which environment do you find more conducive to your professional growth?

    Having experienced both law firm and in-house legal environments, I can say that each offers unique advantages and challenges. The key differences between these two settings can influence professional growth in distinct ways.

    In a law firm setting, the pace is often fast-paced and diverse, with exposure to a wide range of clients, industries, and legal matters. This diversity provides ample opportunities for skill development, as lawyers are constantly challenged to adapt to new cases and clients. 

    On the other hand, in-house legal departments offer a more immersive experience within a single organization, allowing lawyers to develop a deep understanding of the company’s business operations, industry dynamics, and strategic objectives. This depth of knowledge enables in-house counsel to provide more targeted and strategic legal advice, aligning legal solutions with broader business goals. Moreover, working in-house provides opportunities to collaborate closely with non-legal departments, such as finance, operations, and marketing, fostering a holistic approach to problem-solving and decision-making.

    When considering which environment is more conducive to professional growth, it ultimately depends on individual preferences, career goals, and work style. Some lawyers thrive in the fast-paced, client-focused environment of law firms, where they can gain diverse experience and build a robust professional network. Others may prefer the stability, strategic focus, and sense of ownership that come with working in-house.

    Ultimately, the choice between these two environments depends on individual preferences, career goals, and the type of work that best aligns with one’s strengths and interests.

    With your broad expertise, what would you say is the one thing the current generation can do to excel in their legal careers, considering the dynamic nature of the profession?

    With the legal profession evolving rapidly due to technological advancements, globalization, and shifting societal norms, excelling in this dynamic environment requires a multifaceted approach. However, if I were to highlight one key aspect for the current generation to focus on, it would be adaptability and continuous learning.

    Adaptability encompasses the ability to embrace change, learn new skills, and pivot in response to evolving circumstances. In today’s legal landscape, where new laws, regulations, and technologies emerge regularly, lawyers must possess the agility to navigate these changes effectively.

    Here’s how the current generation can cultivate adaptability to excel in their legal careers:

    • Embrace Lifelong Learning: Continuous learning is essential for staying abreast of legal developments and acquiring new skills. Whether it’s through formal education, professional development programs, or self-directed learning, dedicating oneself to ongoing education fosters adaptability by ensuring relevance in a constantly evolving field.
    • Develop Technological Proficiency: Technology is reshaping the practice of law, from e-discovery tools to AI-powered legal research and contract management platforms.     In short, being adaptable is key to thriving in today’s fast-paced legal field. If current lawyers can adapt well, they’ll do great in their careers despite how things keep changing.

    How do you see a Data Protection Officer can balance the need for data security with the demand for innovation and efficiency in today’s digital age?

    Balancing the imperative of data security with the drive for innovation and efficiency is indeed a multifaceted challenge for a Data Protection Officer (DPO) in today’s digital landscape. Achieving this delicate balance requires a proactive approach that integrates robust security measures with agile and adaptable processes.

    First and foremost, a DPO can ensure that data protection policies and procedures align with relevant regulations such as GDPR, CCPA, or any other applicable laws. This foundation establishes clear guidelines for data handling, access controls, encryption protocols, and incident response procedures.

    To promote innovation and efficiency, one should collaborate closely with their IT and development teams to integrate privacy and security considerations into the design and development of new systems and technologies. By adopting a privacy-by-design approach, one can identify potential risks early in the development lifecycle and implement appropriate safeguards without impeding progress.

    Regular risk assessments and security audits are essential to identify vulnerabilities and ensure that security measures remain effective in the face of evolving threats. 

    Furthermore, one should prioritize the ongoing education and training for all their employees to foster a culture of data security awareness throughout the organization. By empowering staff with the knowledge and tools they need to recognize and respond to security threats,  can minimize the likelihood of data breaches while promoting a collective commitment to protecting sensitive information.

    By employing a combination of regulatory compliance, risk management, education, collaboration, and proactive measures, DPOs can navigate this balancing act successfully, ensuring that data security remains a priority without hindering the organization’s ability to innovate in today’s digital age.

    Your journey includes several internships across different law firms and organizations. Could you share one of your most memorable internship experiences and how it influenced your career path? Additionally, what advice would you give to students regarding the types of internships they should pursue, and how crucial do you believe internships are in shaping one’s legal career?

    I participated in internships as a mandatory part of my law curriculum. Throughout the five-year law course, students were required to undertake various internships based on their interests and career aspirations. During my internship with Tata Steel, I gained valuable insights into legal challenges from a corporate standpoint, particularly from an in-house counsel perspective. Working alongside a seasoned team, I had the opportunity to delve into various legal matters and comprehend the intricacies faced by the in-house legal department. This experience significantly influenced my interest in pursuing a career as a corporate lawyer. 

    My advice to students regarding internships is to seek opportunities that align with their interests and career goals. It’s essential to explore different areas of law to gain a well-rounded understanding of the legal profession. Additionally, internships provide valuable networking opportunities and allow students to build relationships with experienced professionals in the field. I believe that internships are essential for students to explore their interests, gain practical experience, and make informed decisions about their future legal careers.

    With your extensive experience across various industries, which one stands out as the most challenging or rewarding in terms of legal complexities?

    I firmly believe that with a solid grasp of the basics and a commitment to discipline, navigating various sectors and fields of expertise becomes quite manageable. Among the diverse industries I’ve worked in (service industry, publication & education, Edtech, Information Technology Enabled Services (ITes), banking services especially from technology and privacy standpoint), each has presented unique legal complexities. However, I found the technology sector particularly challenging and rewarding. Innovation in technology moves quickly, which can create new legal questions and challenges that haven’t been addressed before. Navigating these complexities requires staying ahead of emerging trends, understanding intricate intellectual property laws, and addressing complex data privacy concerns. Yet, overcoming these challenges can be immensely rewarding, as it involves shaping the legal framework for groundbreaking technologies that drive societal progress.

    You’ve been instrumental in implementing legal training programs for employees. How do you approach balancing regulatory adherence with fostering a culture of innovation within the legal department?

    As a leader in the legal department, I’ve been implementing legal training programs for employees, and I approach balancing regulatory adherence with fostering a culture of innovation through a multifaceted strategy.

    Firstly, I prioritize creating a culture of trust and autonomy within the team. This involves providing flexibility for innovative thinking while ensuring strict adherence to regulatory requirements. By empowering team members to think creatively within the bounds of law, I encourage innovative solutions while upholding legal standards.

    Secondly, continuous legal development is crucial. Our organization invests in ongoing education initiatives, such as seminars, workshops, and access to online resources, to keep the team updated with the latest legal developments. This ensures that innovation is informed by a comprehensive understanding of regulatory requirements.

    Additionally, practical exposure and direct interaction opportunities with key stakeholders play a significant role. By involving team members in meetings, negotiations, and other crucial aspects of legal practice, I foster a deeper understanding of legal and regulatory challenges and encourage innovative approaches to address them.

    Ultimately, my approach aims to strike a balance between regulatory adherence and fostering innovation. By creating an environment of trust, investing in continuous legal education, and providing practical exposure, we cultivate a culture where innovation thrives within the applicable legal and regulatory framework.

    Happy to address this alternate question instead – “You’ve handled transactions in banking and project finance, leading negotiations and client meetings. Can you share a particularly challenging project you managed and how you successfully navigated it?”

    One particularly challenging project I managed involved transactions in banking and project finance, where I served as the legal counsel for a consortium of about 20 lenders, comprising significantly large banks. The complexity of the project lay not only in the intricacies of the transaction but also in the sheer scale of stakeholders involved, each with their own unique perspectives and priorities.

    As the legal advisor representing the lenders, one of the most daunting challenges was to navigate the decision-making process among the consortium members. With a large number of stakeholders, each with varying degrees of influence and interests, reaching a consensus on critical legal matters posed a considerable challenge.

    To address this challenge and streamline the decision-making process, I proposed a solution that ultimately proved to be highly effective. I suggested forming a steering committee comprising the top five lenders by contribution and size. This committee would be tasked with making decisions on legal challenges and strategic matters, thereby expediting the decision-making process and ensuring that key decisions were made in a timely manner.

    Despite initial skepticism from some stakeholders, I was able to effectively communicate the benefits of this approach and garner support for the formation of the steering committee. By highlighting the advantages of having a smaller, more agile decision-making body, I was able to overcome resistance and gain consensus among the lenders.

    The implementation of the steering committee proved to be a game-changer for the project. With a more streamlined decision-making process and faster resolutions to legal challenges, we were able to expedite the transaction timeline significantly. By empowering the steering committee to take decisive action, we minimized delays, resolved issues proactively, and ultimately closed the transaction in a remarkably short time frame.

    This experience taught me the importance of creative problem-solving and effective stakeholder management in complex transactions. By proposing a solution that addressed the specific challenges of the project and gaining buy-in from key stakeholders, I was able to navigate a challenging situation successfully and achieve a positive outcome for all parties involved.

    Given your expertise in legal risk mitigation and fraud prevention, could you share some key strategies or best practices for identifying and addressing potential legal risks within financial institutions?

    In my experience, effective legal risk mitigation and fraud prevention within financial institutions require a multifaceted approach that combines proactive measures with ongoing vigilance. Some key strategies and best practices include:

    • Conducting thorough risk assessments: Regularly assess the legal and regulatory landscape to identify emerging risks and vulnerabilities. This involves analyzing regulatory changes, market trends, and internal processes to pinpoint areas of potential exposure.

    Firstly, it’s paramount to build a robust understanding of core legal principles such as the Contract Act, Companies Act, Transfer of Property Act, and principles of interpretation. These foundational laws serve as the cornerstone upon which specialized areas like finance and corporate law are constructed. By mastering these fundamentals, young lawyers can develop a solid framework for analyzing legal issues and offering effective solutions to clients.

    Additionally, I urge aspiring lawyers to adopt a solution-oriented approach to problem-solving.     My journey from law school to becoming a seasoned counsel has been quite an adventure! There were many pivotal moments and experiences that have helped shape my career path. Starting as a trainee in a top law firm, I learned the ropes from my seniors in the corporate team. I remember feeling a bit intimidated at first, but they were so supportive and patient with me, which really helped me grow and develop. Moving to the Intellectual Property team allowed me to handle huge IP portfolios and gain experience with national and international filings and directly managing the clients. It was quite a challenge, but I loved it! Transitioning to in-house counsel roles at large FMCG and pharmaceutical companies provided me with the opportunity to delve into the business side of legal practice, which was really fascinating. These experiences have been instrumental in shaping my approach to legal practice and have helped me develop a unique perspective that combines legal expertise with a deep understanding of business dynamics.

    You’ve had a diverse range of experiences, both in law firms and in-house roles. How have these different environments contributed to your skill set and approach to legal practice?

    Yes, while starting my own firm was always on the radar, I wanted to be well-prepared and well-equipped for that and I felt it is important to have sufficient experience in Firms and in-house roles for holistic professional growth. Working in both law firms and in-house roles has really helped me develop a well-rounded skill set and approach to legal practice. In law firms, I honed my legal knowledge and expertise in understanding the intricacies, and the art of handling clients, while in-house roles allowed me to gain a broader perspective on the intersection between law and business. It’s been really interesting to see how the two sides of the legal profession work together to achieve common goals. This combined experience has been my USP that sets me and my firm apart. The blend of these experiences has helped me develop a strategic and practical approach to legal practice, where I am able to not only provide sound legal advice but also offer valuable insights on how legal considerations can impact business outcomes.

    As a strategic partner for organizations, you’ve been involved in business development and advising on key initiatives while ensuring risk mitigation and compliance. Could you elaborate on how you balance these sometimes conflicting priorities?

    Balancing business development, risk mitigation, and compliance can be quite challenging at times. As a strategic partner for organizations, my approach is to prioritize risk mitigation and compliance while also supporting key initiatives that drive business growth. This often involves conducting thorough risk assessments, collaborating closely with stakeholders, understanding the practical challenges and pain points, and proactively identifying potential legal issues. By maintaining open communication channels and fostering a culture of compliance within the organization, I have been able to strike a balance between these sometimes conflicting priorities. As a thumb rule, I ensure that Compliance and adherence to Law in its Letter and Spirit is pivotal for the sustainable and scalable growth of any Organisation and as the Legal Counsel, it is one’s responsibility to guide the management of the Companies in the right direction.

    Throughout your career, you’ve been involved in negotiating, vetting, and drafting high-stake contracts. Can you share any strategies or approaches you’ve found particularly effective in these processes?

    Negotiating, vetting, and drafting key contracts is something I Love and am always excited about! But over the years, I’ve developed some effective strategies and approaches that have helped me in these processes. One of the most important things is to thoroughly understand the needs and objectives of both parties involved in the contract. This allows me to tailor the contract terms accordingly and ensure that everyone’s needs are met while complying with all statutory requirements. Additionally, maintaining clear communication throughout the negotiation process, paying attention to detail, and seeking input from relevant stakeholders can help ensure that the final contract accurately reflects the agreements reached by both parties. Another crucial aspect is to interact with the respective department which deals with that particular project, to understand the background, the practical challenges, and the probable risks while drafting, reviewing, or negotiating a water-tight and robust contract. Lastly, following red-lining etiquette and ensuring that you have proper and valid reasoning and rationale for every change made, accepted or rejected is the most effective strategy and art of vetting and negotiating a contract.

    Given your experience in supporting business development projects and signing commercial contracts with partners across various regions, what are some challenges you’ve faced in navigating international legal landscapes, and how have you overcome them?

    Navigating international legal landscapes can present unique challenges due to differences in laws, regulations, language barriers, and business practices across regions. To overcome these challenges, it is crucial to conduct comprehensive research, seek local legal expertise when needed, and establish strong working relationships with local partners. By staying informed about international legal developments and adapting to the cultural nuances of different regions, I have been able to effectively navigate complex legal landscapes and support business development projects across various regions including APAC, AFMET, CIS, LATAM, US, UK and Japan. Yet another major challenge in cross border deals and the most negotiated clauses would be the jurisdiction, dispute resolution and applicable law clauses. The Company and counsels, before deciding on the jurisdiction and applicable laws, have to factor in various aspect such as the costs involved in dispute resolution in a jurisdiction, the practicality of adherence to foreign laws, the risks involved and how stringent/lenient the laws of such country are with respect to the subject matter. 

    There have been interesting instances where some foreign counsels deleted or modified clauses saying it is not in line with their laws, and when we delved deep and tried to understand their laws, it was not the case. Hence while working on cross-border deals, it is important to not just go by the other Party’s interpretation of laws, but personally verify it from our end, either in-house or by seeking local expertise in those countries. 

    Your role has also involved working with cross-functional teams across multiple departments. How do you ensure effective communication and collaboration in such diverse settings?

    Absolutely! The key to successful outcomes in diverse settings is to prioritize open and transparent communication. I actively seek input from all departments involved in a transaction and encourage a collaborative work environment. By fostering a culture of mutual respect and shared goals, I have been able to facilitate effective teamwork and drive successful outcomes across multiple departments. Additionally, I make sure to take approvals, denials, or comments from cross-functional teams in writing and ensure that all stakeholders/relevant departments are marked in such communications to allow other stakeholders to raise any concerns or discussions if any. If it is an oral discussion, I send out the Minutes of the Meeting. This helps ensure that all discussions are recorded and can be referred to later if needed.

    Mentorship and team development seem to be important aspects of your leadership style. Could you share some insights into how you nurture talent within your team and promote their professional growth?

    Yes, I truly believe in nurturing talent within my team by providing opportunities for professional growth and development. I set clear expectations, offer constructive feedback, and empower team members to take on new challenges. Allowing and encouraging the team members to take ownership of every single task they handle, not just gives them confidence, but also makes them accountable for their assignments. Instead of giving them the answers, I tell them how to find the solution. This helps them handle any situation even in my absence and makes them better professionals. Having regular team meetings and brainstorming sessions has helped the team handle their workload meticulously and be abreast of the laws. I also believe in being open to feedback and constructive criticism, as it helps me and my team grow professionally. As Lawyers, it is important that we agree to disagree!

    Looking back at your journey, what advice would you offer to fresh law graduates who are about to embark on their own careers in the legal field?

    I would advise fresh law graduates to invest in continuous learning and professional development to stay abreast of legal developments and industry trends. 

    While it is easy to generate opinions or contract drafts using AI, it is important that every document is drafted meticulously and one understands the rationale behind every line that goes into a contract/document and mastering the art of interpretation. While AI is an effective tool that helps you work smart, it should not be a replacement for your hard work. Mere copy-pasting of language can land up being more dangerous and expensive than one can imagine. 

    Seek mentorship and guidance from experienced legal professionals to gain valuable insights and perspectives. No doubt is a silly doubt, never refrain from asking questions or getting clarification.

    Build strong relationships with colleagues, clients, and industry peers to expand your network and opportunities for growth. Embrace challenges and opportunities for growth, as they provide valuable learning experiences that can shape your career path.

    During my school days, I frequented Tiz Hazari District Courts in New Delhi due to my grandfather’s profession as a lawyer. His encouragement fueled my interest in attending court sessions whenever possible, marking the inception of my journey into law. This passion was further nurtured during my academic years, especially under the guidance of Rahul Sir from the Rahul IAS institute. His notes continue to be a valuable resource, serving as a foundation for resolving intricate legal issues.

    As my career progressed, I recognized the importance of a well-rounded skill set. This realization led me to pursue Company Secretaryship alongside law. This dual expertise eventually culminated in my role as the Legal Head at Devyani International Limited. In this capacity, I oversee legal strategies, compliance, and contribute to the success of the company in the dynamic Food and Beverage Industry.

    With a background in both law and company secretaryship, how do you find these two roles intersecting, and how has this unique combination of skills shaped your approach to legal matters within a corporate setting?

    In your current role, you’ve been involved in a variety of agreements and legal due diligence. Can you elaborate on a specific challenging scenario you encountered and how you navigated through it successfully?

    Expanding into new markets is a challenge for almost all the industries. Thorough legal due diligence revealed discrepancies in local regulations that could potentially impede the business activities. To navigate this, we engage the regional legal experts, conduct exhaustive consultations with regulatory bodies, and meticulously tailored our agreements to comply with nuanced legal requirements. This proactive approach, coupled with collaborative efforts between legal and operational teams, allowed us to successfully navigate the complexities.  

    As an In-house Counsel, you’ve been responsible for ensuring compliance with various regulations. How do you stay abreast of the evolving legal landscape, and how do you ensure that your organization remains compliant with the relevant laws? 

    Being an in-house counsel exposes you to a myriad of scenarios. Analytical and problem-solving skills are essential to skim through each case. Given that law demands constant courtship, possessing knowledge not only about the law but also about the organization’s operations is vital. This necessitates a quest for understanding the company’s role to prevent mismanagement in the long run.

    Developing these skills involves attending workshops, seminars, conferences, and engaging with professionals in the sector. This keeps you updated with current developments and exposes you to diverse opinions, fostering out-of-the-box thinking. Lastly, cultivating a habit of reading is crucial for professional growth, challenging preconceptions, analyzing the status quo, and confronting ideas outside one’s comfort zone.

    In your experience, you’ve handled pre-litigation and post-litigation matters, including drafting legal notices and representing the company in court. Can you share a particularly complex or high-stakes litigation case you’ve dealt with and the strategies you employed to achieve a favorable outcome?

    Handling pre-litigation and post-litigation matters, one complex case involved a landlord refusing to take over the property. To navigate this, a comprehensive legal strategy was devised, emphasizing thorough case analysis, diligent research, and timely collaboration with the external legal counsel. Open communication with all stakeholders, including senior management, allowed for a holistic understanding of the case’s intricacies. A strategic negotiation approach was adopted to explore settlement options, mitigating potential risks. Ultimately, a favourable outcome was achieved through a combination of legal expertise, strategic foresight, and effective communication.

    You have been recognized for your leadership skills and contributions to the business expansion, having successfully closed over 400 property agreements in a short span of 4 years, as acknowledged by the Chief Legal Officer of KFC Global/Pizza Hut. Could you please share some insights into the challenges and key strategies you employed during this expansion process?

    During an expansion process, challenges often arise, ranging from regulatory hurdles to cultural integration. Key strategies involve meticulous due diligence, identifying and mitigating potential risks, and fostering effective communication between all involved parties. Transparent communication with the existing workforce helps manage concerns and ensures a smoother transition. Flexibility in adapting strategies based on the unique aspects of each acquisition is crucial. Leadership in this context requires a holistic understanding of legal, financial, and operational facets, aligning them with the overarching business objectives. 

    Having worked on issues related to intellectual property rights and trademarks, what advice would you give to businesses, especially in the food and beverage industry, regarding protecting their intellectual property in a competitive market? 

    Intellectual property protection is crucial in the competitive food and beverage industry. Businesses should proactively register trademarks to safeguard their unique assets. Regular monitoring of the market for potential infringements is essential. Developing a comprehensive intellectual property strategy involves legal counsel to identify and address potential risks. Collaboration with regulatory bodies and industry associations provides additional layers of protection. Educating employees about intellectual property rights and implementing strict confidentiality measures internally is equally vital. In essence, a proactive and multi-layered approach is key to preserving intellectual property in a fiercely competitive market

    Given your diverse experience, what advice would you offer to fresh law graduates aspiring to build a successful career in corporate law and company secretarial roles?

    For fresh law graduates aspiring to excel in corporate law and company secretarial roles, I would offer the following advice:

    Can you tell us about your journey into the field of law, from your early education to your current role as Senior Legal Counsel at Infosys Limited?

    My journey into the field of law has been both deliberate and transformative. Initially, I embarked on a path in Chartered Accountancy alongside pursuing Bachelor of Commerce (Honours) program at Delhi University. However, it was during this time that I realized my passion lay more in the realm of company and business law rather than accountancy.

    This revelation prompted me to take the entrance exam for law, and I was fortunate to secure a place at Campus Law Centre, Delhi University. This educational shift allowed me to delve deeper into my newfound interest, laying the foundation for my legal career.

    The academic rigor I experienced at law school made me realize that I enjoyed legal research and the discipline that comes with academic writing. I therefore decided to pursue a master’s degree in law and was fortunate enough to get accepted into one of the world’s best LL.M. programs at the University of Cambridge, United Kingdom. 

    At Cambridge, I had the opportunity to delve into a diverse range of subjects, from International Taxation to IP rights and Corporate Financing. This international exposure broadened my horizons and equipped me with a comprehensive understanding of global legal frameworks and practices.

    Upon completing my education, I joined Vaish Associates, where I honed my practical legal skills. Working on complex matters related to the Income Tax Act, 1961, I had the privilege to collaborate with renowned legal professionals such as Mr. Harish Salve, Mr. P. Chidambaram, and Mr. Kapil Sibal. These experiences not only enriched my legal expertise but also instilled in me the importance of diligence, teamwork, and taking ownership of tasks.

    Transitioning to Panasonic as the legal counsel for their Innovation Center was another significant milestone in my career. Here, I was responsible for providing end-to-end legal advisory for cutting-edge technology platforms. My role was multifaceted, encompassing everything from conducting compliance seminars to drafting policies on vendor procurement, social media, anti-bribery, and privacy law.

    Now, as a Senior Legal Counsel at Infosys, I continue to navigate the dynamic intersection of law and technology. My journey from studying Commerce to choosing law has been a continuous learning experience, shaping me into the lawyer I am today.     At Vaish Associates, I had the invaluable opportunity to gain field-level exposure as a lawyer, focusing on tax litigation and arbitration. This experience was instrumental in enhancing my understanding of the functioning of the court, the mindset and interpretation of judges, and the intricacies of commercial and tax laws /regulations. I learned to navigate complex legal issues, anticipate potential challenges, and develop effective strategies to advocate for clients and protect their interests.

    Transitioning to Panasonic’s in-house legal team and subsequently to Infosys, I applied the insights and skills gained from my litigation experience to navigate the complex regulatory landscapes and provide strategic legal counsel across different sectors. My ability to analyse complex legal issues, identify creative solutions, and communicate effectively with diverse stakeholders has been greatly enhanced by my deep understanding of litigation.

    Further, at Panasonic, I had the opportunity to work as a legal counsel with its Innovation Center. This provided me with a unique opportunity to immerse myself in the world of technology and innovation. As the lead counsel of the Panasonic Innovation Centre, I was responsible for providing end-to-end legal advisory for cutting-edge technology platforms, conducting compliance seminars, and drafting comprehensive policies. This experience taught me the importance of staying abreast of technological advancements, understanding industry-specific regulations, and effectively communicating complex legal concepts to non-legal stakeholders.

    Transitioning to Infosys, has further broadened my horizons and refined my approach to legal practice.

    As a lawyer with a mix of litigation and in-house experience, it equipped me with a multifaceted skill set, enabling me to become a more rounded lawyer and cultivate a proactive, solution oriented, and forward-thinking mindset.

    Could you share some insights into the challenges you’ve faced while navigating the legal landscape in both corporate and commercial settings?

    One of the primary challenges I’ve faced is staying abreast of the ever-evolving regulatory frameworks and industry-specific regulations across different sectors. The legal landscape is dynamic, with laws, regulations, and compliance requirements frequently changing in response to technological advancements, global trends, and socio-economic developments. Keeping up with these changes requires continuous learning, proactive research, and a deep understanding of the nuances and complexities of each sector.

    Another challenge I’ve encountered is balancing legal rigor with practical considerations and business objectives. In corporate settings, legal counsel often plays a strategic role in guiding decision-making, managing risks, and facilitating business transactions.     Your expertise includes areas like corporate finance, intellectual property, and international taxation. How do you stay updated in such dynamic fields, and how do you apply this knowledge in your day-to-day work?

    One of my key strategies for staying updated is to cultivate a diverse and extensive professional network, comprising colleagues, peers, and mentors across different sectors, industries, and jurisdictions. It’s essential to actively participate in industry conferences, seminars, and engage in professional associations, and collaborate with external advisors and experts to exchange insights and share best practices.

    Additionally, I leverage a variety of resources and platforms, including legal publications, journals, newsletters, and online databases, to access up-to-date information, case studies, and regulatory updates. I also engage in continuous self-directed learning, professional development, and skill enhancement through online courses, certifications, and training programs- the most recent courses completed by me are Anti-bribery and Corruption, M&A Regulation and Compliance, and Concept of Privacy by Design. 

    Applying this knowledge in my day-to-day work involves analytical skills, and practical experience to address complex legal issues and develop tailored legal advice for stakeholders, and cross-functional teams. I strongly believe that one of the essential elements of being an in-house counsel is to collaborate closely with colleagues and stakeholders to understand their needs, and objectives, and accordingly develop innovative, pragmatic, and ethical solutions that align with business goals. 

    Furthermore, I have always taken every opportunity I’ve had to share the information, knowledge, and experience that I have gained during my years navigating the multifaceted and complex work undertaken by me as the in-house legal counsel for two separate Fortune 500 companies, to other members of the legal community either through presenting my learnings in conferences or conducting trainings for various departments within my organization. I actively mentor and train the Infosys’ Legal Process Management (LPM) Team which comprises young lawyers and routinely help them understand the deeper nuances of technology, IPR and Data Privacy Law, along with advising and guiding them on honing their drafting and negotiation skills.

    In essence, staying updated in dynamic fields requires a proactive, multidimensional, and holistic approach to learning and professional development.

    As someone deeply involved in contract negotiation and management, what are some key strategies you’ve developed for ensuring successful outcomes in complex agreements?

    During my 10-plus years in the legal profession, navigating complex contract negotiation and management has been a critical aspect of my role. I’ve had the opportunity to participate in and lead several ‘first of their kind’ transactions in the IT Services sector. These transactions inter alia involved, advising on innovative structures to provide IT services, negotiating complex high-value software development and licensing agreements, as well as advising on and representing my organization in private and public tendering processes.

    One of the key strategies according to me is to conduct comprehensive due diligence, identifying potential risks, challenges, and identifying creative and innovative, solutions to complex legal, commercial, and regulatory issues, and develop flexible, and adaptive, contract structures, terms, and conditions that align with business goals, support innovation, mitigate risks, and provide clarity, certainty, and predictability for all parties involved.

    A crucial aspect of this approach is the importance of understanding the business and project well to be able to negotiate effectively. By gaining a thorough understanding of the business objectives, market dynamics, competitive landscape, regulatory environment, and the specific requirements, goals, and constraints of the project, I am able to align legal advice and contractual terms with business goals, support innovation, mitigate risks, and provide clarity, certainty, and predictability for all parties involved.

    Additionally, effective collaboration with various internal and external stakeholders to successfully close the time-sensitive transactions is an essential part of being a commercial contracts counsel.

    Your achievements include awards for legal excellence and contributions to data governance programs. In your opinion, how significant do you believe receiving awards and recognition is for legal professionals, and how have such accolades influenced your career trajectory and professional development? 

    While awards and recognition in the legal profession may not always translate directly into monetary gains, their importance, in my opinion, should not be understated. 

    These accolades serve as invaluable markers of expertise, dedication, and contributions to the legal field, bolstering credibility and enhancing reputation among peers, clients, and potential employers. 

    Such awards have been instrumental in shaping my career trajectory and professional development in ways that go beyond financial incentives. They have opened doors to new opportunities, such as networking events and speaking engagements, which have enriched my professional network and professional growth.

    Lastly, considering your journey and accomplishments, what advice would you offer to fresh graduates aspiring to pursue a career in law?

    Reflecting on my journey in the legal profession, I have several pieces of advice for fresh graduates aspiring to pursue a career in law.

    Firstly, prioritize continuous learning and professional development. The legal landscape is constantly evolving, so staying updated by attending workshops, seminars, and training sessions is essential.

    Secondly, focus on building a strong professional network. Networking with peers, mentors, and industry professionals can open doors to new opportunities, provide valuable insights, and offer support and guidance as you navigate your career path. Remember, relationships built early in your career can serve as valuable resources throughout your professional journey.

    Thirdly, seek out diverse experiences and opportunities to gain hands-on experience across different areas of law. This will not only help you discover your passion and areas of interest but also make you a more well-rounded and versatile legal professional, capable of adapting to different challenges and opportunities.

    Additionally, maintain a strong work ethic, integrity, and commitment to excellence in all aspects of your work. Building a reputation for reliability, professionalism, and ethical practice is crucial for long-term success and credibility in the legal profession.

    Certainly! My journey within FinTech has been both exciting and fulfilling. It all began with a keen interest in technology and its transformative potential in financial inclusion.

    During my early years as a lawyer, I observed the rapid growth and innovation in the FinTech space. I was fascinated by how startups were leveraging technology to create innovative solutions that addressed challenges in the financial industry. This led me to delve deeper into understanding the intricacies of FinTech law which continued to do a catch up behind technical innovation.

    As I continued to work with startups, I realized that they face unique legal challenges that require specialized knowledge and expertise. From navigating complex regulatory landscapes to protecting intellectual property and ensuring compliance with evolving laws, startups in the FinTech sector need legal guidance tailored to their specific product offering and target audience.

    Over the years, I have had the privilege of working with BankBazaar, KredX, Flipkart and Razorpay leading startups at various stages of their growth. This hands-on experience has allowed me to develop a deep understanding of the industry’s nuances and the legal and compliance frameworks that govern it.

    In addition to working directly with startups, I have also been actively involved in the broader FinTech community, attending closed group industry body forum discussions/ committees and seminars, and staying updated on the latest trends and developments in the industry. This continuous learning and engagement have been instrumental in honing my skills and staying ahead of the curve in the rapidly evolving digital finance and payments industry.

    You’ve had a diverse career path, ranging from law firm to in-house counsel. How have these different roles shaped your approach to legal advisory within the startup ecosystem?

    Starting my career with a law firm provided me with a strong foundation in understanding the intricacies of legal practice and the importance of rigorous research, analysis, and advocacy. Working in a law firm environment exposed me to a wide range of clients and industries, allowing me to develop legal skills and the ability to adapt to different regulatory challenges and scenarios.

    Transitioning to an in-house counsel role was a pivotal moment in my career. It offered me a unique perspective by immersing me directly into the operational and strategic aspects of a business. As an in-house counsel, I had the opportunity to work closely with business leaders, entrepreneurs, and cross-functional teams, gaining insights into the day-to-day challenges faced by startups and the broader business considerations that influence legal decisions.

    This dual experience has enabled me to approach legal advisory within the startup ecosystem with a holistic and pragmatic mindset. I understand the importance of aligning legal strategies with business objectives, prioritizing risk mitigation while fostering innovation, and providing practical solutions that support startups in achieving their goals.

    What sparked your interest in the FinTech and financial sectors? Could you elaborate on some of the innovative strategies you’ve employed in your legal practice?

    I have always been fascinated by how FinTech can break down barriers of reach, scale and physical paperwork, create new opportunities, and redefine the way we think about financial services.

    In my legal practice, I adopt a proactive stance towards regulatory compliance. Rather than reacting to regulatory shifts, I work with stakeholders to foresee future trends and develop compliant strategies from the get-go. This approach allows me to navigate the regulatory landscape confidently and strategically.

    Additionally, I believe in collaborative relationships between startups, financial institutions, and regulatory bodies. By fostering open dialogue and partnerships, we can create a more harmonious ecosystem that encourages innovation while maintaining regulatory compliance and consumer protection. It is important to have regular open discussions with the regulators and licensing authorities to understand their perspective and their take on risks and consumer protection.

    Given your extensive experience in areas such as digital lending, payments, and data protection, how do you stay updated with the rapidly evolving regulatory landscape in the FinTech industry?

    Staying updated with the rapidly changing rules and regulations in the FinTech industry is crucial. To maintain a comprehensive understanding, I employ a systematic approach to staying informed. This approach allows me to deepen my expertise, refine my analytical skills, and adapt to the evolving regulatory environment effectively.

    Firstly, I regularly read industry news, updates, and legal articles about FinTech. This helps me keep track of new rules or changes that could affect the industry and understand emerging trends related to FinTech.

    Secondly, I attend seminars, workshops, and conferences focused on FinTech regulations and compliance whenever possible and actively participate in industry forums. These events provide valuable opportunities to learn from experts, engage in discussions with peers, and explore important issues in the field. Participating in these events allows me to share ideas, learn new strategies, and gain different perspectives on how to address regulatory challenges effectively.

    As a mentor and leader, you’ve curated a proficient team of lawyers. How do you foster an environment of responsibility and dedication within your team, especially in such dynamic industries?

    A captain is only as good as their team! Creating an inclusive work environment and ensuring equal opportunity within the team has always been a top priority for me. Here’s how we collaboratively approach this as a team:

    Clear and open communication is fundamental to our team’s success. By setting transparent expectations and outlining our collective goals, we as a team develop a roadmap that empowers each team member to take ownership of their roles. This clarity not only offers direction but also cultivates a sense of purpose and accountability among all team members.

    Throughout your career, you’ve provided guidance on contract management, regulatory compliance, and legal matters. Could you share a particularly challenging case or project you’ve worked on and how you navigated through it?

    One of the exciting projects I have worked on involved advising BankBazaar, my previous employer, on expanding into new international markets. The main challenge was dealing with different rules and regulations in each country about financial services and technology. Each place had its own laws, making it hard to make sure we followed all the rules.

    To tackle this, I led a team to study the rules in each country carefully. We looked at what the local regulations were for the FinTech industry and what risks we might face. Based on this research, we created a detailed plan to help us follow the rules in each country while still achieving the company’s goals. 

    Reflecting on your journey, what advice would you give to fresh graduates aspiring to pursue a career in law, especially those interested in specializing in the FinTech sector?

    Here’s some advice I’d give to fresh graduates aiming for a career in law, especially in the FinTech sector. First, focus on developing your critical thinking and problem-solving skills. These skills will help you tackle complex legal issues and find innovative solutions, making you stand out as a valuable legal professional. Second, be resilient and adaptable. The world outside law school can be challenging, so having the perseverance to overcome setbacks will help you grow stronger in your career.

    Next, stay updated with technology and legal advancements. The legal sector is constantly evolving, and being tech-savvy will help you work more efficiently. Also, practice negotiation skills. These abilities will be crucial when resolving deadlocks and securing positive outcomes for your clients. Additionally, seek out a mentor or guru in your field of interest.     Could you share a bit about your educational journey, particularly how you transitioned from your LL.B. degree to pursuing LL.M. in Intellectual Property Law at The George Washington University Law School?

    While completing my BA.LL.B, I enrolled in a diploma course in Intellectual Property Laws at the Indian Institute of Law during my third year of law school. It was during my fourth year, as part of my curriculum, that I delved deeper into Intellectual Property law, sparking a keen interest in the subject. By the time I reached my final year, my aspiration for higher education had crystallized, leading me to forgo immediate employment in favour of pursuing advanced studies. I applied to several esteemed law schools in both the US and UK renowned for their offerings in Intellectual Property Law. Upon receiving admission to George Washington University, widely recognized for its excellence in this field, my decision was made without hesitation.

    Your LL.M. focused on Intellectual Property Law, among other areas. What sparked your interest in this field, and how has this specialization influenced your career path?

    I became interested in intellectual property law (IP) while studying it during my undergraduate studies. It is fascinating because it mixes law, technology, creativity, and new ideas. During my LL.M., I became even more interested in the subject. In today’s corporate landscape, whether working as a corporate lawyer for a multinational corporation in industries such as oil and gas, IT, pharmaceuticals, or others, it’s imperative to have a keen awareness of the intellectual property (IP) owned by your company. Understanding how to safeguard these assets from infringement is paramount. My master’s degree in Intellectual Property Law has played a pivotal role in meeting this requirement. I’ve found that understanding and safeguarding intellectual property is crucial for the success of any company. It’s been instrumental in my ability to comprehend and effectively protect the intellectual property assets of the organization I work for.

    You’ve had significant experience in both law firms and corporate legal departments. How did these varied experiences shape your understanding of legal practice, especially in the context of intellectual property law and corporate governance?

    Upon completing my master’s degree, I sought advice from industry peers and well-wishers who advised me against exclusively focusing on IP at the outset of my career. As a result, I began my career in litigation. After gaining experience in litigation for several years, I transitioned into a role as a corporate lawyer within a software company. It was within this company that I once again engaged with IP matters. Particularly during negotiations for licensing agreements, my prior experience with IP proved invaluable.

    Can you elaborate on your role as a Principal Attorney at McDermott, specifically in the domain of sustainability and governance? How do you integrate legal expertise with sustainable practices within a corporate environment?

    As Principal Attorney at McDermott, my responsibility is to assist our supply chain team in their endeavours to procure materials and services essential for project execution. In addition to contract negotiation, my team and I provide legal training to enhance their understanding of relevant clauses, thereby empowering them during negotiations. Ensuring adherence to the code of business conduct is paramount in all our activities, particularly concerning sustainability and governance initiatives.

    You’ve worked extensively in drafting and negotiating various contracts, including those related to engineering procurement. How do you navigate the complexities of legal frameworks across different jurisdictions, given your experience in regions like the Middle East, India, Europe, and Africa?

    In our contractual agreements, we opt for common law as our governing jurisdiction. This choice is deliberate, as contracts governed by common law principles share remarkable similarities across various jurisdictions worldwide. This uniformity simplifies our navigation of legal frameworks and enhances our ability to manage contractual obligations effectively across different regions and jurisdictions.

    As someone deeply involved in legal compliance and risk management, how do you stay updated with evolving regulations, especially in areas like intellectual property and corporate mergers?

    As someone deeply involved in legal compliance and risk management, staying updated with evolving regulations, especially in areas like intellectual property and corporate mergers, is crucial. I employ various strategies to ensure I’m informed about the latest developments. This includes continuous learning through workshops and seminars, staying updated with legal publications and journals, active participation in professional networks, regular engagement with legal counsel, and monitoring government and regulatory websites for official updates. These efforts enable me to proactively manage legal compliance and mitigate associated risks for our organization.

    Transitioning from law school to your current role, what were some of the challenges you faced, and how did you overcome them? Are there any lessons you learned along the way that you would like to share with aspiring legal professionals?

    It has been over a decade since I graduated from law school, and I must say, it has been a journey of continuous learning for me. Transitioning from litigation to corporate law posed its challenges. Initially, my experience in litigation wasn’t fully recognized, and I found myself starting from scratch in the corporate world. However, as time progressed, my background in litigation has proven to be advantageous. Today, it gives me a unique edge over other corporate lawyers.

    To all aspiring legal professionals, I offer this advice: remain open to learning every day. Be like an empty vessel, ready to absorb new knowledge and experiences. This mindset is essential for growth and success in the legal field.

    Finally, considering your journey and expertise, what advice would you give to fresh law graduates aspiring to build a successful career in intellectual property law or corporate governance?
